Mr. Moe, let me say this again: a murder is not a tort. A murder is a criminal law question while a tort is a civil law question. The two are completely different. The burden of prove in a murder case is "beyond all reasonable doubt" while the burden of prove in most tort cases is "the preponderance of the evidence". This means that it is easier to prove a civil case (tort) than a criminal case. Now I have to say that a criminal murder case like the O.J. Simpson case you referenced above has been acquitted (O.J. is set free), in such situations the victim's qualified relatives can sue for a lesser offense of "wrongful death" which is not a criminal action but a civil action. You will recall that the girl who sued Kobe Bryant also did not prevail with the criminal suit of rape, but she eventually filed a civil action. Civil suits, if successful are awarded monetary damages instead of jail time as in most criminal cases. I hope I am being clear here...

Well, I think you are just running around in circles here Mr.Moe. First you made an outrageous statement that "a murder is a tort", you got that wrong; second you tried to hide behind the O.J. Simpson case without realising that that case involved two separate cases, a criminal case and a civil case, you got that one also wrong; thirdly now you are shifting to the killing of students. But this one really reveals that you probably do not know what you are talking about. you said the "killing of the students do not fall under the category of murder...but a wrongful death", didn't you previously said that "a murder is a tort"? Whether that case of the students will be pursued as a criminal case, murder or a civil case wrongful death will depend on the plaintff(s) and their attorneys strategy and what they want to achieve based on the facts and the evidence. It is pompous to sit under the Mango tree in your village without all the facts and the evidence and make a decision about the case... Thanks. |

Well i thought your foolish ass would come up with a lame excuse like that. When i tried to explain to your foolish uncle what it entails we were talking about the student murders etc. They were not murdered my friend. It will be a civil suit and the only way anyone can even succeed in wining that case is if its a wrongful death suit. I ain't hiding behind anything i can sit here all day and prove my point Kayjatta i only used the Oj simpson case to show you how foolish and retarded you are. Unlike you i drop my lines like hot cakes and everything is signed sealed and delivered extemporaneously . i Bet you feel like a retard now, don't you old fart. Foolish fools like you ain't got nothing to do but sit on the bantaba and talk ying yang all day like an intellect that you ain't. If you wanna be a good citizen idle hands go back to your vilage and teach them how to read and write Or go back to the farms lowlife. This city boy is out of your league. Your sorry ass sat there and could not say crap all this time ,you were just waiting for something that you felt was not well said so that your punk ass can shine village boy.......................................Peace quote: Originally posted by kayjatta

Hey Moe thanks for your responses. It is however your choice to get educated or die in ignorance. Sorry about my "lectures" as you called them, I know it hurt your pride, but you know I thought it is good to offer you a chance to learn something new. Everybody need that time to time, right? I do often... Sorry I cannot join you in throwing insults, I have passed that stage I guess but you can go home and check your facts because your blanket statement that "a murder is a tort" is wrong... |
