The principal magistrate at the Kanifing Magistrates' Court, Kayode Olajubutu, has resigned and left the country since last Sunday.

A source close to the court said Mr Olajubutu has landed an international appointment, although he would not give details.

Kayode Olajubutu, a Nigerian citizen, was reportedly offended by the promotions of Justices Ikpala and Ahmadi to the High Court by the Chief Justice Emmanuel Agim. Instead of promoting Olajubutu, the CJ moved him from Bundung Court to Kanifing Magistrates' Court - well, at least closer to the capital.

Magistrate Olajubutu would be remembered for sentencing UDP campaign manager, Femi Peters to a mandatory one year jail term with a fine of D10,000. Peters was found guilty of organizing a political rally without police permit.

It was Olajubutu who convicted and sent the disgraced Kombo North law-maker, Musa Suso to prison in December of 2009. A year earlier, Olajubutu convicted a police superintendent Manlaffi Sanyang of stealing the president's car and sent him to prison. Manlaffi died in custody three days later.

Olajubutu was the magistrate who remanded prominent Gambian politician Halifa Sallah in custody in March 2009. Halifa was arrested by authorities and charged with leading an unlawful procession and inciting violence after the politician had visited rural dwellers affected by the state sponsored witch-hunt in which 1000 people were arrested and two reported deaths.

And following our Thursday lead story on the chief prosecutor's strike for back-pay, Richard N. Chenge was arrested on Friday for insubordination. He's not yet charged with any crime. According to our correspondent, Chenge was conspicuously missing at a Judicial Review seminar at the High Court on Friday, where an unnamed Ghanaian law professor delivered lectures on judicial review and law reforms.

Asked about whether the arrest of Chenge had anything to do with the escape from detention of the star-witness to the prosecution of former police chief, Ensa Badjie, Our correspondent replied: "That's nonsense. What had he to do with that? Sillaba Samateh was never charged with anything; he was arrested, however, detained, and coerced into testifying against Ensa Badjie, Major Kuluta Manneh and Lt Col Mam Matarr Secka as the first prosecution witness", he said.

Sillaba's sister, Nyaranding Samateh, was also arrested alongside their Brusubi home watchman following Sillahba's escape from detention. For Nyaranding, our reporter said, she was arrested because she had signed the D200,000 bail bond at the NIA headquarters in Banjul to secure her brother's release. Armed Security men now guard Sillahba's Brusubi home

Despite all the beautiful and pretty pictures the fact remains was Femi Peters guilty of the crime he was accused of? I will elaborate further whats next for Mr Peters since I am his real lawyer online. Ousainou Darboe failed him and he will have no option but to serve his term in prison. There was no mercenary Judges involved in the outcome of this trial. The UDP party made a stupid irrational decision and had to pay for their propaganda and thats about it. Santafara is dumb enough to be another Martyr for the opposition party. In all essence might as well justify releasing the newest guest at Mile Two prisons. Why jail foreigners when all they are doing is defending a cause which most of ya'll don't believe in but they believe in it enough to be involved. If party leaders turn out to be irresponsible citizens and aspiring leaders, it makes me wonder what the average Joe in the streets thinks of these incompetent saviors............................................................Peace

That is after 1 year without a presidential pardon Senegambia. All this rhetoric will not solve the problem. I will tell you how Darboe failed Femi Peters Snr and Jnr. I will give you a break down of the process and surely prove to anyone that Darboe is an incompetent attorney, This is just my point of view based on the realities and whats applicable by Law and mind you I never went to Law School either. Lets make that an I.O.U till tomorrow. I will give you another Master piece regarding the Femi Peters incarceration bro.......................................................Peace

State counsel NB Jones has raised preliminary objections, contesting 11 out of 14 grounds of appeal filed by the appellant, Femi Peters, the jailed UDP former Campaign Manager, describing the grounds as incompetent.

The state counsel cited Section 275 of the Criminal Procedure Code to further buttress her objection.

"The grounds of appeal are 15, only 4 grounds complied with the mandatory requirement under Section 275 of the CPC, and 11 out of 14 have not complied with the law with regards to the subordinate court," she told the court.

State counsel Jones urged the court to consider only grounds 4, 7, 9 and 10 as competent grounds and facts of argument, and the rest of the grounds as incompetent.

She finally urged the court to strike out 11 grounds of the appeal and consider only four grounds.
In response, Lawyer Ousainou Darboe, the counsel for the appellant, said the submission made by the respondent that the court should strike out the grounds is misconceived, stating that all the grounds of appeal are competent and are facts of argument.

Lawyer Darboe read some of the grounds challenged by the prosecution to the court, noting that the objection raised by the prosecution will all be spelt out in his written brief.

He said the convict at the magistrate court did not open his defence and the trial magistrate threatened to send him to jail, if he failed to open his defence.

The court later ruled against the prosecution's objections.

When the appeal case was called at yesterday's hearing, the counsel for the appellant told the court that he has served the prosecution with the records of proceedings obtained from Kanifing Magistates#146; Court.

State counsel Jones told the court that she was not served, but Lawyer Darboe insisted that a copy of the proceedings was sent to prosecution.

At that juncture, a reserved copy was immediately served to the state counsel.

Lawyer Ousainou Darboe had earlier applied to the court that he was ready to file in either oral or written briefs, which he said, will contain all the arguments.

Justice Amadi then gave the appellant's counsel five days to file in the written briefs, while state counsel Jones, for the respondent, was given seven days to file in written replies, and to reply on points of law.

The case was then adjourned to 14 July 2010 for adoption of briefs.

Femi Peters, the former Campaign Manager of the opposition United Democratic Party (UDP) is currently serving a jail term of one year following his conviction by the Kanifing Magistrates' Court.

His conviction was for holding a political rally and using a loudspeaker without a permit from the Inspector General of Police, as required under the Public Order Act.

Peters subsequently filed an appeal against his conviction at the High Court in Banjul.
