This from the Point,
Lady Njaimeh Jawara and two others have been dragged to court by Lansana Sillah, the plaintiff. Lady Njaimeh Jawara, her co-defendants, Alhagie Wandifa Jawara, the 2nd defendant and the 3rd defendant (unnamed) are before Justice Haddy Roche of the Banjul High Court in respect of a land sale entered into between Lansana Sillah and Lady Njaimeh Jawara

By chance, is it Gambia's former first lady?
Can anyone confirm this?
I personally think that the 'land tenure ' system should be re-visited beacuse many people has become victims of this.

And Again,this is getting very serious now all these court cases which would not have got to court had the government developed a trustworthy proceedure together with documentation so that everybody who enters such transactions knows exactly what papers they should have and what they should do,times are past when word of mouth and oral history were enough,now paper documents have to be drawn up.

Magistrate Ayoub John Njie of the Brikama Magistrates Court has warned a law enforcement officer not to meddle in matters that contravene the law, saying a police officer should lubricate the wheel justice delivery system and not throw a spanner into it.
The magistrate gave this warning to one Momodou Suwareh, a police officer, who has been dragged in a civil suite filed by one Mrs Mama Jarra against him as the first defendant and Alasana Jawo, the Alkalo of Farato Village, about a land deal

These cases are numerous and no one knows the exact numbers. Only the ones that are in court are noticed. The problem is just creeping like a bush wild fire with no resolution at all.

Thats what I was thinking because no one likes going to court and paying lawyers fees but when there is no nationally accepted system of land sales ,transfers and registration there is no alternative,I am certain that this would be a vote winner for the government if they could institute such a scheme,or perhaps H.E. dosn't want one? |

Snippet: Manlafi Touray, a businessman in Abuko Village, recently filed a civil suit before Magistrate EF M’Bai of the Brikama Magistrates Court, against one Babansu Sanyang, involving two pieces of land at Tujereng Village, Kombo South.
According to the claim sheet, Mr Touray, the complainant, is claiming for the repossession of a piece of land situated at Tujereng Village measuring 72m x 63m and 50 m x 64m, valued at D350,000. Mr Touray is also said to be claiming for the repossession of another piece of land that is situated at the same village, measuring 72m x 49.5 and 74m x 52m, valued at D350,000.

Settled out of court.
Lady Njameh Jawara, Others’ Land Case Settled gambia Friday, June 13, 2008 The land case involving Lady Njameh Jawara, Alhagie Wandifa Jawara and Abdou Magid, which was before the Banjul High Court, has finally been settled. Both parties on Thursday informed the court presided over by Justice Haddy Roche that they had reached an out-of-court settlement and that both parties are satitisfied with the terms of the agreement.
It could be recalled that Lady Njameh Jawara and her co-defendants were dragged to court by one Lasana Sillah in connection to a land transaction between him and Lady Njameh Jawara. It turned out that the same land situated at Brikama Nema was again sold to the third defendant, Abdou Magid, by Lady Njameh Jawara.
The plaintiff, Lasana Sillah, was claiming the recovery of the sum of D320,000.00 being the money he paid to Lady Njameh Jawara as the cost of the said land. By Modou Sanyang

Snippet: A group of five people living in Farato village, Kombo South, Western Region, has recently petitioned the Secretary of State for Local Government, Lands and Religious Affairs, in connection to a seemingly emerging land dispute between them and Ahmadiyya Muslim authorities. The issue of land dispute, especially within the Western Region, has in recent months been the subject of series of cases in the courts.

This problem of land falls into two catagories. There is a very good and adequate system of buying and registering land. This system has a very good paper trail. Some europeans use it in conjunction with a solicitor, at a fraction of the cost in Europe. There is a local system that only includes the alkalo, without full registration with the land registry. This is where most of the problems arise.This is used to avoid charges. I personally witnessd a dutch person hand over 10,000 Euros in return for a hand written piece of paper. When brought to his attention he explained to me "this is how they do it in Gambia" (I have only lived in Gambia foe 40 years) People need to use a bit of common sense, especially Europeians who seem to loose it as soon as the sun comes out. In europe no one would think of purchacing property or land without a solicitor. Why do they not use one in Gambia? |

Thanks Doc I feel better now,can I stop taking these pills for depression? I was unaware of any "very good and adequate system of buying and registering land. This system has a very good paper trail." this is great to know,with so much confusion about buying land in Gambia those who wish to do so can be assured that there is a good system in place.Very useful.
