The case of Fatou J. Manneh is (and should be )a grave concern for all of us. It is terribly unfortunate that our government could prosecute its citizens for expressing their opinions . What has happened to the freedom of speech in the Gambia ?
The presiding magistrate in Fatou's case is Buba Jawo. Jawo was my contemporary at Saints , I remembered him there before I branched off to Gambia High for Sixth Form.
Recently there has been much speculation about what Jawo's role might be in the outcome of the sedition trial of Fatou J. Manneh. Dbaldeh went as far as comparing him to the U.S. celebrity defence attorney Johnie Cochran.While i see a lot of problems with that analogy , i will limit myself to what Magistrate Jawo can possibly do with this case.
It is important and realistic to realize that unless some procedural or substantive defect happens to the prosecution's case Jawo may have to stand by the previous decisions of the court in similar cases (stares decisis).I do not think Fatou's case is one of first impression , I mean there might be some case law that are on point with her case.
Another important factor is whether Jawo will tend to be a judicial activist by departing from the courts's previous decisions in similar situations.If he sets a new precedence that harm government interst he could pay a high price for it. So one has to know or understand Jawo's temperament and independent mindedness to suspect his verdict.But this case in my opinion depends more on the lawyers than the Magistrate.
Last week Jawo was in the news complaining about a government prosecutor being absent from court without cause. Despite his fury he did not dismiss or threaten to dismiss that case. If that incidence is something to go by Jawo may not be the one to depart from the status quo.

thanks for ur rejoinder. i share your arguement greatly which, to my guess is why editor Baldeh argued the piece in that way,obviously very fitting after a test editorial. After all the sole intention is to draw people's attention on it, and to have the majistrate acquit-clear message on the editorial.

having said that, Jawo's recent absence in court during Fatou's last hearing (alleged bereavement), and the fact that you mentioned (he didn't threaten to strike out journalist Fatty's case) is something to hold him on. he is shaping his own history, either to degrade himself or preserve the rest he is being associated with by contributors here.

I doubt the credibility of this Gianako onlinewspaper. Most of you who support them are hiding your iidenteties. Why be afraid if you speak or report the truth? Most of you having suggestions on Gambia are just mare paper tigers unless you make us know who you are. This is my stand point. Most of you using all sorts of names are false if not why hide? We have seen how your Pa Nderri is been exposed. God has commanded us to stand for the truth even if it means death. I do not take all this debates serious because you are too false. This is my opinion. If you want people to take yopur views seriously, come forward like Halifa Sallah and the opposition has done. Do not sit back in your so called country and try to teach Gambians how to govern, when you use false identeties. This I suspect is to mislead people to get into toruble with the government at home. This idea is very rutten indeed. We use this platforms for discouraging purposes.
Some investors I shall travel to Africa very soon chose to skip Gambia because of this nonsens. Come out from you wolf skins and debate as decent citizins. The Gambia Government cannot decide yours or my life. We must be truthful and come out plain. I have even spoken to Modou Camara in regard to this. People hiding their identity, can be very decisive. AS we say in Sweden "TO BUY A PIG IN A SACK OR A SNAKE IN A HOLE"
This is what you people with hidden identeties want us to do. I for one will never ever neighter buy nor do I take your opinions seriously. I thought we were honest to eachother, but we are not.
Those who feel offended can explain why all this hiding?
Are your postings and statements or ideas fake?
How can you hide from people you are giving suggestions to or people you want to wake up? The right thing is to come forward and pratice what you preach. Then we shall take you seriously.They are not fools, remember there are others who see through all these.

Alhassa , just a quick question here: If someone donates to you but prefers to remain anonymous would you say outright his/her donation ill-intentioned ?
As far as I see our contributions here (whether right or wrong) are like donations -of time and ideas- to our beloved country. We could just shut up and mind our business. Most of us have better things to do , like the Nigerian lady I recently met and asked her about the state of affairs in Nigeria. She didn't even know about the recent election there. She thinks she has better thinks to do than follow events back home.
The ongoing problem confronting Fatou J. Manneh in the Gambia should open your eyes to the reality that the regime in the Gambia does not appreciate criticism and will go a long way to silence you. Didn't they try to silence Halifa Sallah you have mentioned ? Didn't he and co been to jail?
There is some sense in using pseudo-names on this forum because many of us are young Gambians and have families back in the Gambia that we support and like to visit occasionally. We do not quickly want to put all that in jeopardy.Besides many other writers-poets , novelists and playwrights-prefer to use pen names instead of their own names for good reasons.
I can see your concern about on-line newspapers , and I agree with you in that many of them have limitaions because they are not on the ground nad their sources may not be objective. But journalism is not always about objectivity and accuracy; it is also about activism and entertainment.

It is the entirity of the people. You might have a bone to pick with any of us, and you are welcome to participate. Pa Nderry is at Freedom and not Gainako. Go ahead and follow the achrives and place before this forum, for example a piece that you disagreed with, critique it, and lets see your own take. Until then, your own credibility is also at stake.

See the misfortunes in many like you, you failed to realize news outlets don't belong to individuals. They are for everyone to particape. Intellectual dishonesty is a worst disease, and hypocrisy breeds violence. Many a times, people who critique, either don't know how to critique constructively, or have some anger problem to drop down.

I tell you what, you probably suffering from some anger-disease or influence of impulse, that you cannot even relate people and where they belong. I challenge your honesty, and lets debate the topic to end......
