In the appeal of the NADD trio

The Gambia Court Of Appeal, at the end of the appearance of three appellants (Halifa Sallah, Hamat Bah and Omar Jallow) declined to rule on the application for bail made by the counsel for the three appellants. According to the presiding judge, Justice Savage, bail together with all the issues involved in the appeal will be decided on on Monday 12th December. The three appellants were charged and brought before the high court on 18th November, 2005. Omar Jallow and Halifa Sallah are charged with one count each of sedition. They are also charged with making false statements against the President and the Government. Hamat Bah is charged with unlawful retention of official document. At the trial, they asked the trial Judge, Justice Paul to recuse himself from the case. The trial Judge refused to recuse himself and proceeded to enter a plea of not guilty for all three defendants. He also remanded all of them in custody on his own motion and adjourned the trial till 14th December 2005.

The appeal of the defendants is to set aside the entire proceedings of 18th November, 2005, presided over by Justice Paul. During the hearing of the appeal today, Mr Darboe, the leading counsel of the appellants applied for an affidavit to be made part of the records of the court. The affidavit contains the following statement made by Justice Paul: "I know some of you do not like me". The prosecutor who was in court that day said she could not remember whether Justice Paul made the statement or not. She asked for an adjournment to allow her time to react. This led to an application for bail by one of the counsels for the appellants, Antouman Gaye. He argued that the charges are bailable and that the Court Of Appeal is competent in granting bail. However, the court of appeal decided to consider this matter together with the entire appeal of Monday 12th December, 2005. The presiding Judge gave full assurance that a final on the matter will be made on Monday. The case was adjourned till Monday.

The two other members of the panel of the Court Of Appeal judges were Justice Agim and Justice Izuako

Brothers & Sisters,

Patience leads to perseverance. We are at a critical moment, and the breaking point of the twisted arms. The wish of jammeh is for us to take to the streets so that he can shoot some, arrest the rest and laugh more. This is a hard time for making decisions, and by God , in whose Hands the Gambians souls are, Jammeh will wish that he was never born, a day that is in the pipeline soon.

We are really tired, totally tired and running out of time, but "patience" will get us there. As i spoke with crying fellows today, i couldn't control emotions, as attendees at the court described the situation as very pathetic, because it is interpreted that they are likely not to be bailed.

I tell you Justice Savage is intelligent, but a drunkard whose alcoholic influence supercedes nationalism and patriotism. By far, i know he is better than justice Paul (his second thought of being a Gambian -and not a Nigerian judge-selfish, selfish, selfish and money conscious.)

Brothers and Sisters, what is also certain from the onset is that the arrest of these "three" fellows is not done merely. This is done on purpose. If innocent fellows can be killed, tortured, intimidated and arrested , with the doers going free all the time, this is no exception-a continuation of the routine that has been on for 11 yrs now.

Gambians , we need to rise up from our sleep. Lets unite, irrespective of any difference, and this is a common enermy for all of us. It seems as though we endorsed a gun man for ousting Jawara in the beginning, and now our reward is to test the sweetness of that evil. This is like a curse on us (tears).

With the ongoing trend, what will a defeated jammeh do-other than taking to the guns again. That, i know with certainty. And i remember asking Halifa sallah that question- what will a defeated jammeh do ??? I still remember-

My silence is because i am overpowered by what is happening, as if my imagination is reading too far into this issue, and may be true, but.... I know what jammeh is capable of doing, and every one knows more than me probably.

Lets do more prayers then. Lets unite. Lets rise up, and lets do it-i mean now, not later.

May Almighty God forgive us for our sins (if any), for which we are getting punished...ameen.
