Below is a press release from Halifa, directed to the IEC. What i was enjoying in the piece is the tone of the language. It is a saying in pularr, " a cow doesn't know the use of its tail until a kondorong-kudayni cuts it.", kewlol-halpularr. It is obvious that when that happens at the time that mosquitoes, flies and birds (sar-waadu- special african birds that eats the flesh of cows through the wounds) start eating that flesh, it cannot wiggle that tail no more to scare or drive them away. Africans, you don't know how much you got about Halifa and Nadd. Enjoy him while he is alive.

NADD Describe IEC Press Release as Unconstitutional

The opposition National Alliance for Democracy and Development (NADD) yesterday issued a statement describing the Independent Electoral Commission’s press release announcing the appointment of Mustapha Carayol as the Returning Officer for the election to the office of the president as unconstitutional.

Below is the unedited version of NADD’s statement signed by its coordinator, Mr Halifa Sallah.

Your press release indicating that, Mr Mustapha Carayol, Chairman of the IEC has been appointed the returning officer for the election to the office of the President and that he will receive nomination of candidates on 28th August 2006 is in contravention to the requirements of the constitution and should be null and void.

You would recall that the whole nation has been informed that the office of Chairman of the Commission is vacant after the removal of Mr. Ndondi Njie as Chairman.

Section 42 Subsection (7) of the constitution states that three members of the Commission “including the Chairman shall form a quorum, provided that any decision of the commission shall require the concurrence of a majority of the members.”

It is therefore incontrovertible that members of the commission cannot make any decision at the moment without the presence of the Chairman. Suffice it to say, at the time of issuing the press release on 31st July 2006 the commission had no Chairperson.

In short, section 42 subsection 10 of the constitution reveals that “before assuming the functions of his or her office, a member of the commission shall take and subscribe to the prescribed oath.” It goes without saying that after the removal of Mr Ndondi Njie no person has taken the prescribed oath to assume the office of Chairman of the IEC.

To avoid impunity and arbitrariness in decision making we strongly advice the rest of the members of the commission to restrain themselves from issuing public notice that are not backed by any constitutional mandates. This will undermine the integrity of the Commission.

Furthermore, we have received a press release indicating that the list of voters for the supplementary registration of voters will be published at the IEC regional offices. The best place for displaying the lists is in the very villages and wards or registration centres where people went to be registered so that the people of the village or ward can do proper scrutiny. Your administrative decision to publish lists in administrative headquarters may be seen as a design to evade scrutiny. Needless to say, 99, 424 persons have registered. Raising objections against even 1000 persons would cost 25, 000 dalasis given the fee of 25 dalasis imposed by the commission for each objection.

The fee may also be seen as a design to evade scrutiny since getting a voters card is free.

In our view, the IEC should engage in a dialogue with all the stakeholders who are represented in the Inter Party Committee on all these issues.

We need both truth and a compromising spirit to enable us to have a relatively free and fair election in accordance with a realistic time able. We therefore expect an immediate commencement of a dialogue between the IEC and the interparty committee failing which we shall begin legal action to seek judicial redress of the short comings. In this way we will not have our hands bound by unreasonable fees, centralization of lists at administrative headquarters and a shortened and over crowded election time table.
