18 charged with indecency after Gambia dance

Eighteen alleged homosexuals [16 Gambians, one Nigerian and one Senegalese national], were Tuesday, April 10, 2012, arraigned before the Kanifing Magistrates’ Court, charged with indecent practice among themselves, contrary to the Laws of The Gambia.
The accused persons, Alieu Sarr, Kebba Ceesay, Abdoulie Bojang, Amadou Jallow, Ogika Amenechi, Amadou Nyang, Ousman Gomez, Sainey Fatty, Lamin Konateh, Lamin Sarr, Buba Banda, Ebrima Jallow, Lamin Saho, Abdoulie Cham, Ousman Dibba, Lamin Jaiteh, Abdoulie Saidy, Muhammed Manneh, appeared before Principal Magistrate Sheriff Tabally.
According to the particulars of offence, the accused persons mentioned above on the 5th April 2012 at Serrekunda and in diverse places, were engaged in an indecent practice among themselves at a public place, thereby committed an offence. They all pleaded not guilty to the offence.
The prosecutor, Cadet Inspector Kanteh objected to the bail of the accused persons on the grounds that the matter is still under investigation and some of the accused persons are at large. He therefore applied for an adjournment to call his witnesses.

Seventeen Gambians were yesterday arraigned at the Kanifing Magistrates’ Court, charged with indecent practice between males. they were subsequently remanded in custody, following their denial of the charge. They are Alieu Sarr, Kebba Ceesay, Abdoulie Bojang, Amadou Jallow, Amidou Nyang, Ousman Gomez, Sainey Fatty, Lamin Konateh, Lamin Sarr, Buba Banda, Ebrima Jallow, Lamin Saho, Abdoulie Cham, Lamin Jaiteh, Ousman Dibba, Abdoulie Saidy and Muhammed Manneh. According to the charge sheet read in court, on 5 April 2012 at Serrekunda and diverse places in the Kanifing Municipality, they engaged in indecent practice among themselves. The police prosecutor, Cadet Inspector Kanteh, objected to bail for the accused persons on the grounds that the investigation was still going on. Magistrate Tabally then urged the police to expedite their investigation, and consequently remanded the accused persons in custody.

Foity Jobe and Awa Touray were charged with indecent practice between females, while Ogika Amenechi was charged with indecent practice between males. They all denied the charge, and were each granted court bail of D100, 000 with two Gambian sureties, each of whom must deposit their ID cards with the court, following the bail application by the defence counsel Badou S.M. Conteh. However, the prosecuting officer, Chief Inspector Darboe, objected to bail for the accused persons, on the grounds that the prosecution intended to file more charges against the accused persons. According to the charge sheet read in court, Foity Jobe and Awa Touray, on 5 April 2012 at Serreunda and diverse places in the Kanifing Municipality, engaged in indecent practice among themselves. Ogika Amenechi was also alleged to have engaged in indecent practice on 5 April 2012, at Serrekunda and diverse places in the Kanifing Municipality. The case was adjourned till 19 April 2012. Thursday, April 12, 2012 Two alleged lesbians and an homosexual were Wednesday arraigned at the Kanifing Magistrates’ Court presided over by Principal Magistrate Sheriff Tabally. Faity Jobe, Awa Touray, Gambians; and Ogika Amenechi, a Nigerian are charged with indecent practice among themselves, contrary to the Laws of The Gambia. According to the particulars of offence, Faity Jobe (1st accused) and Awa Touray (3rd accused) on the 5th April 2012 at Serrekunda and in diverse places were engaged in an indecent practice in a public place among themselves, thereby committed an offence. For the second accused, Ogika Amenechi, the particulars of offence revealed that on the same date and place, he was engaged in an indecent practice between him and other homosexuals, thereby committed an offence. They all pleaded not guilty.
The defence counsel for the 1st and 3rd accused, Lawyer Badou Conteh made an application for the accused persons to be granted bail, citing that they have been in police custody for more than 72 hours. He said that the 1st accused is married with two children while the 3rd accused works for a promotion company. He assured that if granted bail, they will always be available in court.
But the Police prosecutor, Chief Inspector Darboe objected to the application made by the defence counsel, noting that the law is not a one-way traffic and does not recognise anyone. He added that other accused persons were last Tuesday charged for the same offence and are currently remanded in prison, so the same should apply to the accused persons. The presiding magistrate, however, overruled the prosecutor’s objection, saying that the offence is a bailable one. Here we go again! So who and where are the so called 'tourists' in these allegations. What kind of 'dance' was being organised? If this kind of discrimination wasn't so serious this whole issue would be laughable. The same old rhetoric being used. Taking us back to the 'Stone Age'in 2012 !!! Sad!

In The Gambia media has a habit of publishing the names of suspected criminals as soon as they get arrested, which generally is avoided here (Sweden). Are trials in the Gambia open to anyone to attend?
I have also noticed that the legal cases and judgements/rulings are published online, on the government's website! There are a lot of documents concerning ongoing trials. Here one can request copies of trial documents including interrogation records, but we do not find them online so far. So Gambia is a bit ahead of us, aren´t they?

Since when has it become a crime to dance wearing clothes of opposit sex? For centuries it is a custom in the Gambia for women groups to perform dances wearing the clothes of their men. An example is this photo of the women's fools cultural group.

They shouldn't have but they succumb to the dalasis opportunity.
It may not be normal & it is definately not something of new but if u have tourism then a wage can be earned from the norm to the adnormal - this time around the price is going to be very high for the Gambians involved in their adnormal activites.
There appear to be a lot of misinterpretation of words, i.e homosexuals & homosexuals acts, lesbians - nothing about transvestites or tranny clubs. Unfortunately it appears to be high on the social activites in all western countries.
U only have to 'google' transvestites or cross-dressers for whichever country to see the enormous availability of websites, clubs & forums.

When the case came up, the police prosecutor called his first witness to testify. In his testimony, Abdoulie Sowe, a police officer attached to the Kairaba Police Station at the CID Unit said that he recognised all the accused persons,
and he also said that he could not differentiate between the men and women because they were all dressed like ladies.
Only three police officers in attendance for twenty Gambian cross-dressers at an abnormal (tourist) function...that doesn't appear to be the usual way of The Gambia Police establishment, did they not require reinforcement?
Some of this does not read/feel correct to me.
