Thanks Momodou,I know I am simple but today is 8th of May quite a few days after "Monday 9th April at 3pm for continuation of cross examination by the state." from which I am to infer that no one turned up from the state so everything is left hanging and the state saves face by not appearing ? Or have I missed something ?

I appears that the burying your head in the sand option has been chosen by the administration,in other words if we don't mention it any more it will all go away and people will forget, not me though,I really think that my favorite Gambian has had a really rough deal, being a man of great integrity he should not have been treated in the way he has.

Let the case be adjourned Sine die.

The criminal trial allegedly for giving false information and sedition involving Moses B. Johnson Richards, a private legal practitioner, resumed yesterday at the Banjul Magistrates' Court before acting-Principal Magistrate Alagba.

Thanks Momodou, when will these people stop playing games and let the man get on with his life.
"Justice rushed" in this case it certainly should be and the defendant discharged, can't really ask for costs against the state though

The case was adjourned till 19th May 2011.

DW3 ENDS TESTIMONY IN MOSES B JOHNSON RICHARDS CASE
By Mamadou Dem on 03-06-11
Modou Colley, a photographer and the third defence witness in the case of Barrister Moses B Johnson Richards, who is charge with giving false information to a Public Officer and Sedition, on Wednesday, 1st June, continued to testify before acting Principal Magistrate Alagbe Taiwo Ade of the Banjul Magistrates’ court.
Senior counsel Antouman Gaye, representing the accused person, alongside Segga Gaye, reminded the court that at the last adjourned date he made an application to tender photographs together with their negatives but the Director of Special Litigation Daniel O Kulo objected and applied for an adjournment and that he was supposed to come with reasons of his objection.
State counsel Simeon Abi told the court that he has been directed by Mr. Kulo to withdraw the objection and which was granted by the court. The photos and their negatives were then admitted and marked as defence exhibit A1.
At this juncture, senior counsel Gaye told the court that this was all he had for DW3.
State counsel said he has no cross examination for the said witness.
The Magistrate ordered that the sermon file by Counsel Gaye be served to Junkung Colley, the Director of Physical Planning.
The matter was adjourned to Monday, 6th June, for continuation of hearing.

Well done kobo, Thanks, I don't want this topic to fall beneath the radar until "somebody" has made the correct decision to let my favorite Gambian get on with his life without interference and resume his rightful place in Gambian society, will this happen soon ?,only one person knows !

So after legal nonsense,it's another delay;

Oh, please guys! [Justice delayed is justice denied]. They've wronged this man in a number of ways. First, they want to put his credibility at stake. second, they want to humuliate him. Third, they want to waste his precious time. All said and done, I can conclude that they hate the man's quest for true justice. I can't believe the level at which they are frustrating the man's efforts....but just a quick reminder, that is called mercenary judges fron Nigeria. They have a whole gang, and take a note.

Physical Planning director continues testimony in Moses Richards’ case

Africa » Gambia

Tuesday, June 28, 2011

Momodou Colley, the director of Physical Planning & Housing yesterday continued his testimony as 4th defence witness (DW4), in the ongoing trial involving the state against Moses B. Johnson Richards at the Banjul Magistrates Court, presided over by Magistrate Ade Taiwo Alagbe.

In his evidence-in-chief, Colley recalled that he had sometime spoke with the alkalo of Jabang on the telephone, who at one time came to report the matter to him. According to him, he advised the alkalo to find a legal expert to assist him in the matter. He told the court that there was one instance when the alkalo of Jabang arrived at the office of the accused, and he (the alkalo) called him to confirm whether there was a panel that reported on the matter, adding he had also spoken with the accused on the telephone at that juncture to confirm the same question which he did. According to him, he was part of the panel, but noted that they had never finalised any report at any level and nothing was implemented as well.

He admitted that the alkalo also adhered to his advice but not on the same day. While under cross-examination by the state counsel Morris Agiah, Colley further insisted the report made by the panel had never been finalised and he (DW4) could not be able to know hence “I am not the final decision maker.”

He finally made it clear to the court that the committee set up for the matter had never stopped the execution of the order of the court. The case was subsequently adjourned for hearing.
