What !!!
How on earth can a magistrate who is tasked with administration of justice in his court make such a statement ? this really shouts out that the Gambian executive is in charge ,in a fair system if the prosecution fails to turn up without reasonable excuse or due notice being given to the court, the defendant stands an excellent chance of being discharged through lack of prosecution.Not here obviously.

UPDATE FROM FOROYAA NATIONAL NEWS- Richards Case AdjournedUNDER http://www.foroyaa.gm/modules/news/article.php?storyid=6499

"The trial Magistrate upheld the application of the defence counsel on the grounds that the matter was adjourned at the last adjourned date at the instance of the state. The case is adjourned to Wednesday 30th March for cross examination."

Thanks KOBO for being the Indexing Master,I have a feeling that the court, prosecution,lawyers and administration really wish that this farcical case would disappear forever,but hey it is vital for someone that they shouldn't lose face.I wish that my favorite Gambian is able to continue his role in the legal profession without hinderence,but with all these delays it is evident that instructions for that to happen have not been given.

This from the point gives the name of the magistrate on this occasion,something that the Daily News report failed to do,I am quite surprised at,I had assumed that the Daily News understood that this is more than just an ordinary court hearing.

Court Adjourns RICHARDS’ CASE

The case of barrister Moses B Johnson Richards who is charged with giving false information and sedition on Thursday 28th April failed to proceed before acting Principal Magistrate, Alagbe Taiwo Ade, of the Banjul Magistrates’ Court.
The case did not proceed because no one represented the state. The trial magistrate showed the defence a letter which was sent by state counsel Simeon Abi asking for an adjournment. Senior counsel Antuman Gaye who is defending the accused did not object to the state’s application for an adjournment.
The matter was then adjourned to Monday 9th April at 3pm for continuation of cross examination by the state.
