What is up with these people ? it would appear that SOME of the parties involved don't know what to do and are frightened that "if they have a go" things may well not go their way,my favorite Gambian has kept his own council and is just observing,GREAT, what a shrewd and sensible man

The Point again appears to be the only paper interested in the fate of my favorite Gambian, a date for a decision has been reached, I bet with much consultation between many people.

Acting-principal Magistrate Taiwo Alagba of the Banjul Magistrates’ Court has set 12 September 2011, as the day he would deliver judgment in the case of Moses B. Johnson-Richards

This development followed the adoption of written briefs by both the state prosecutor and the defence during yesterday’s proceedings of the case.

The charge sheet on count one stated that Moses B. Johnson-Richards, on 6th November 2010 at Banjul, knowingly gave false information to the Sheriff of The Gambia to wit that His Excellency the President of The Gambia has ordered the stay of execution of the writ of possession in civil suit No 349|92 B No.28, with intent to cause the Sheriff of the Gambia to stop the execution of the said writ of possession.

Count two read that Moses B. Johnson-Richards, on 6th November 2010 at Banjul, published a letter to the Sheriff of the Gambia, stating that His Excellency the President of the Republic of The Gambia had ordered a stay of execution of a writ of possession in civil suit NO349 B No.28, with intent to bring into contempt the person of the said President.

After eight months of legal battle, Moses Richards, an ex-judge, now a private legal practitioner is today expected to know his fate on false information and sedition allegations he is facing at the magistrates’ court in Banjul.
He is alleged to have given false information to the Sheriff of The Gambia, that the president of the Republic ordered a stay of execution of a writ of possession in a civil suit; thus gave false information to a public servant and brought contempt into the person of the president of the Republic. He however denied any wrong doing.
The prosecution, it could be recalled, closed its case following the testimonies of two witnesses, including the Sheriff of the High Court.
The defense called three witnesses after the testimony of the accused person namely Pa Ebrima Colley Alkalo(village head) of Jabang, Momodou Junkung Colley, Director of physical planning and Modou Colley, a photographer who took pictures of the eviction exercise in Jabang village in 2007.

The much anticipated judgment involving Lawyer Moses B. Johnson Richards could not take place yesterday at the Banjul Magistrates’ Court as expected.

When the case was called, the president of the Gambia Bar Association, Sheriff Marie Tambedou, announced his representation for the accused person.

Magistrate Tabally then informed the court that judgment was not ready, and that the case file was not with him.

Counsel Sheriff Tambedou told the court that the case should be mentioned so that it would be on record.

The case was then mentioned, and adjourned without a date being fixed.

The particulars of offence on count one stated that Moses B. Johnson Richards, on 6 November 2010, at Banjul within the jurisdiction of the court, knowingly gave false information to the Sheriff of The Gambia to wit that His Excellency the President of the Gambia, has ordered the stay of the execution of the writ of possession in civil suit No.349/92 B No. 28, with intent to cause the Sheriff of the Gambia to stop the execution of the said writ of possession.

In my experience Sine Die cases are rarely reactivated,its a great legal way to make things go away,no body wins, but the prosecution still has a right to proceed with permission of the court,I suspect that as this file is not with the judge it has become "lost" I hope that this is the total end of this matter.

I am not a lawyer,but I do know a little about how the courts work in England,do not even try to understand Janyanfara ,things that are not ideal exist in all justice systems not only the Gambian justice system .
I strongly suspect that no one will help you with answers.
