Two arrested and charged:

The first British charges for female genital mutilation were announced today in a landmark decision by the country’s top prosecutor.
Director of Public Prosecutions Alison Saunders said two people, one a doctor, would appear in court charged with carrying out the crime at London’s Whittington Hospital in November 2012.
The alleged crimes involve the practice of “re-infibulation” in which the vagina of a woman previously subjected to FGM is sewn up again after giving birth to leave only a tiny opening.
The two people charged are Dr Dhanuson Dharmasena, who is accused of carrying out the mutilation, and Hasan Mohammed, who is alleged to have aided and abetted in the crime.

FGM has no place in UK. If people choose to live in UK, they should accept the cultural norms of the society.
In UK women are theoretically equal to men (we still have a way to go), and women have control over their own bodies.
FGM is not acceptable.
If anyone can provide a cultural justification for this I will be interested to listen to it. |

The law in England to take offenders to court has been in existence since 1985,yet this is the first occasion that it has reached the courts. |

"I have also determined that Hasan Mohamed should face one charge of intentionally encouraging an offence of FGM, contrary to section 44(1) of the Serious Crime Act (2007), and a second charge of aiding, abetting, counselling or procuring Dr Dharmasena to commit an offence contrary to S1 (1) of the Female Genital Mutilation Act (2003). These decisions were taken in accordance with the Code for Crown Prosecutors."
The identity of the patient has not been revealed. Dhamasena, 31, from Ilford, Essex, and Hasan Mohamed, 40, from north London, will appear at Westminster magistrates court on 15 April." SOURCE: The Guardian & more information

VERY VERY GOOD Point, as is the case the lawyers and their retinue of barristers clerks,expert witnesses,will be jostling and rubbing their hands at the astronomical fees that they will gain if they represent the defendant,rest assured every single word of the law will be analysed and each letter picked over in those words of written law,as there has not been a prosecution since the law came into being in 1985 there will be no case law for them to consider,this case will make case law,which can be cited should any other cases be brought to court by the CPS. |

This information leaflet is written for women who are considering having a vaginal hysterectomy and/or vaginal repair. The information is of a general nature and your care will be tailored to your own needs. What does the surgery involve? A vaginal hysterectomy is the removal of the uterus (womb) and the cervix through a small cut in the top of the vagina. Removal of the ovaries is sometimes possible although not commonly done at the same time. The usual reasons for performing a vaginal hysterectomy are heavy periods or a prolapsed womb. Not all women are suitable for a vaginal hysterectomy and it can be difficult if the womb is enlarged or if you have not had vaginal births. It is not usually possible to remove the ovaries during a vaginal hysterectomy. A vaginal repair is an operation for women who have a prolapse. It may sometimes be performed to treat stress incontinence (leaking urine when laughing, coughing, sneezing etc). It involves making a cut in the vaginal wall and closing the skin closer together to reduce the bulge in the vaginal wall. When the operation is performed to treat a prolapse of the front wall of the vagina it is called an anterior vaginal repair. An operation to treat a prolapse of the back wall is called a posterior vaginal repair. Vaginal hysterectomy and vaginal repairs can be performed either on their own or as a combined operation.'''

I have a feeling that this case will not be cited in future court appearances,why?, I think that the defendants will be acquitted,might be wrong I often am,wait and see . Be very interesting to read the speeches of barristers of both sides,from official court records. (obviously there will be a FEE for such information !)

Toubab 1020. Hear what Solicitor General said and published in London Evening Standard news today Monday 24 March 2014:
FGM law reforms vital to stop horrific abuse, says Solicitor General Oliver Heald
Major changes to the legislation on female genital mutilation are needed to stop perpetrators of “horrific” abuse escaping justice, one of the government’s top law officers said today.
Solicitor General Oliver Heald said the existing law was “full of loopholes” and that ministers needed to act to make it “easier” for prosecutors to bring charges.
He added that reforms — including a legal duty on parents to prevent their children from mutilation and a requirement for health and education staff to report cases — could be carried out before the election. Changes could also include covering perpetrators who were temporarily living here instead of applying only to permanent residents as at present.
Mr Heald’s comments come just days after the Director of Public Prosecutions, Alison Saunders, announced that a London doctor and another man are to be prosecuted for alleged FGM offences in the first such charges since the practice became illegal in 1985....
