Independent witness collapses in ex-IGP Badjie's voire dire Africa » Gambia Friday, August 20, 2010 The voire dire in the criminal trial of ex-IGP Ensa Badjie failed to proceed yesterday, 19th of August 2010, at the High Court in Banjul, when the independent witness collapsed minutes before the commencement of the said voire dire before the presiding judge, Justice Emmanuel Amadi.
The voire dire was ordered by Justice Amadi following the defence objection to the admissibility of one of the ex-IGP Badjie's cautionary statements as prosecution exhibit, on the grounds that the said statement was not obtained voluntarily from his client. The prosecution led by the DDPP, Mikailu Abdulahi had called the first witness who testified in the voire dire and denied torture allegations claimed by the defence.
The mini-trial was adjourned for the prosecution to call its second witness, who appeared yesterday. When the case came up, the DDPP, Mikailu Abdulahi urged the court to grant him a short stand down to enable him interview and confer with the independent witness. The application was granted and other cases were called. While DDPP Mikailu Abdulahi was interviewing and conferring with the independent witness outside the courtroom, the witness suddenly slumped and collapsed on the court verandah.
He was then carried by two police officers to a separate location where some first aid was administered to him. DDPP Mikailu Abdulahi, who was terrified with what he saw, hurriedly rushed into the courtroom and informed the court of what transpired between him and the independent witness who was expected to testify in the voire dire. He then craved the court's indulgence to grant the prosecution a short adjournment, noting that the witness has been taken away for medical attention by security operatives. Justice Emmanuel Amadi who expressed regret at what transpired, disclosed that he wanted to conclude the main case during the vacation. He then adjourned the case to the 24th of August 2010 at 9.30am for continuation.
Recast
It could be recalled the ex-IGP Ensa Badjie, Mam Matarr Secka and Kuluteh Manneh are standing criminal trial on multiple charges ranging from conspiracy to commit seditious act, sedition, abuse of office, official corruption, obtaining goods by false pretence, economic crime, among others.
