I'm getting married to my Gambian boyfriend in April having been together for 5 years. He has had a visa for dubai before now and will apply for a UK settlement visa once we are married. We would like to travel out side of the uk and possibly work in france. does anyone know what paper he will need to visit other eu countries and will he be able to work outside of the uk in France or will he require a seperate visa to live and work in france? i am struggling to find iformation on this.

Denise. UK Settlement visa is not guarantee as you are just getting married. You really need to have some valid evidence that your marriage is genuine. So, support your application with pictures, letters, bank wire transactions, western union transactions, DHL receipts etc.

Even you get a settlement visa for UK, you still need to apply for work visa for France. UK visa does not give you right to work in other countries in EU. Working in another EU countries is a right for only EU citizens.

Sound advice from Turk. I don't think settlement visa is automatic on marriage although a short term visa (I think up to two years) may well be. Then you have to prove marriage still working (as I understand). If he wants to travel to France he will also need a French visa - the UK visa is only valid for the UK.

Settlement Visa – This is the form your spouse will be filling in;

www.ukvisas.gov.uk/resources/en/docs/1903073/vaf4a

Give special attention to guidance for part 8 & part 11 (supporting document checklist)
Plus around Twenty two thousand dalasi

After two years in the UK there is the
Life in the UK Test / ESOL) http://www.lifeintheuktest.gov.uk/
Which may give him indefinite leave to remain after completing the required documents - www.bia.homeoffice.gov.uk/sitecontent/.../settlement/formsetm042009.pdf

Special attention to Guidance notes Section 10 (documents)especially Note 8.
www.bia.homeoffice.gov.uk/sitecontent/.../settlement/guidesetm042009.pdf

http://www.legalcentre.org/index.php?category=11&submenu=22

There are a number of Home Office requirements that need to be met to keep your Indefinite Leave to Remain status. For example you are not allowed to spend more than 2 years outside the UK and you should consider the UK as your home. If you do not meet these requirements your Indefinite Leave to Remain status may be withdrawn.

To move freely in the European Union he/you will need a Schengen Visa.
http://www.ambafrance-uk.org/What-is-a-schengen-visa.html

http://www.ambafrance-uk.org/-Visa,805-.html

Great Britain HAS NOT signed the Schengen Agreement. Therefore, even if you hold a permanent or temporary residency permit to reside in the UK, i.e. even if you live here, you may still need a visa in order to enter the Schengen zone.

Some reading to keep you occupied - hope it helps both of you & that you may help others in the future from it.

Nice vision you have but there appears to be a long road ahead before you reach France.

Sab your points are spot on. The things is most people including some Europeans don't know that there are few EU Treaties that UK is not a signatory e.g. Schengen Agreement.

Monday, yes and the rules never stand still:

Plus I believe it was Molly who didn't realize interviews had been scrapped:
6) The interview phase has been removed (from migration watch below)

http://www.migrationwatchuk.org/pressArticle/70
This was a key deterrent to bogus students and potential terrorists. It has virtually gone. Of the 66,000 Pakistanis granted a visa to enter Britain in a nine month period, only 29 were interviewed.

Schengen is not a work visa. So, for Denise husband, it is useless even UK signed Schengen. He needs work visa which is only given by French Government and main requirement is a reputable company sponsorship.

Turk, yes the work permit is another matter that can be found under DOCUMENTS REQUIRED to stay (and work) in France. As the Schengen visa definition states its about free movement - but with the links provided & Denise already a seasoned traveller I assumed she would take on her homework.

Entry and Residence of non EU Nationals
Non EU Nationals are not allowed to take up employment in France, even temporary, paid or unpaid, unless they have obtained an "Autorisation de Travail" (work permit) before arriving in France. The prospective employer should apply for this permit to the:
Office des Migrations Internationales
14, rue Brague 75015 Paris
Tel: 0033 1 53 69 53 70

This works in all EU countries and my husband has applied according to that law/rule. Im eu citizen, working and living in other eu member state and we are married. One has to be prepared to proof the marriage to be serious:pictures, dokuments, phonebills, stamps at the passport, erything. That is the hard part since I try not to save old dokuments...

Greetings Everyone,

Molly 75 its ok for your fiancee to stay in the UK for up to six months. However is very important for him to leave the UK before his visa's expiry date otherwise he will find it very difficult if indeed impossible to be issued another UK entry visa

Denise did your Fiancee come to Britain on a Fiancee visa? if he did then you'll have no problem getting married in the UK in April. If on the other hand he didn't then you'll probably have to return to Gambia and get married. Or reapply through Gambia for a Fiancee visa to allow you to get married in the UK.

Once you're married you can apply for a spousal visa at the British High Commission on Atlantic Rd Fajara. A Spousal visa latest for two years. In that time your Spouse can work but has no recourse to public funds.

Within the last six weeks before the Spousal visa expires he'll have to make an application for indefinite leave to remain for a fee of £1020 fast track and £840 via the mail service. And of course as Sab mentioned he must do a life in the UK Test/ESOL.

I give thanks that's all behind us now my husband got his indefinite leave to remain last month

I wish you all Good luck

Peace

Sister Omega, I am so glad you have got through all the procedures.
How long did it take you in total?
How did you meet your man and where is he from in Gambia?
It's lovely to hear of couples that make it work!!!

Hi Bev,

I met my husband at Gatwick airport by the luggage machine at arrivals. He was travelling here on business. We'd both got off the same Monarch flight. He saw me waiting for my luggage and brought me over a trolley.
We got talking about Fouta Toro and the rests history. We've been together for 4 years in March and married for over two years now. My husband is from Central Division Gambia.

Peace

How romantic! I love those sort of stories...you should write a film script!

I know we have had our intellectual differences, but I think we are both concerned for Gambia and have our hearts in the right place.

Which village in central divison is he from? Private email if you prefer. I could say hi to the family if its close to where I visit!
