Should ladies be arrested just for being out at 10pm at night ?
KAY,Can you quote the definition of "rogue and vagabond behaviour " under Gambian Law,(you not being an Attorney of course, but someone who can give this information to us laymen.)
35 Young Ladies Charged Thursday, October 15, 2009 34 women and a minor girl of 16 years, yesterday 14th October 2009, pleaded not guilty to a charge of rogue and vagabond behaviour levied against them by the state.
A collection of ladies were arraigned at the Kanifing Magistrates’ Court, presided by Principal Magistrate Joseph E Ikpala for allegedly contravening Section 167 of the Criminal Code, Laws of The Gambia.
The following are the accused persons constituting both Gambians and non-Gambians: Fatou Sanneh, Fansainey Fatty, Bintou Sanneh, Amie Colley, Sonna Saidy, Mariama Barry, Nyima Colley, Sainabou Jobe, Isatou Camara, Oumie Jallow, Aminata Camara, Rebeca Enodo, Matida Enio, Astou Bah, Banna Colley, Clinda Rebeca, Amie Bah, Issatou Lamarana Bah, Aji Joof, Nafisatou Camara, Tracy B. Joco, Edi Jusu, Mariama Jatta, Binta Sawaneh, Rugiatou Bah, Yafatou Mbye, Jankey Colley, Kadijatou Jallow, Adama Sowe, Agnes Katty, Awa Colley, (name withheld), Jenifa Barry, Isatou Wally and Mamy Jeng.
According to the particulars of offence, the alleged suspects were arrested at Bertil Harding Highway and diverse places within the Kanifing Municipal Council where they were found wondering along the Highway at about 22:00 hours which led to the conclusion that they were there for illegal or disorderly purpose to wit soliciting men for prostitution.
Upon reading the charges to the accused persons in the language they claimed to understand, all of them strongly denied the charges.
The Police Prosecutor, Inspector Ahmed Touray then applied for a short adjournment to enable him call his witnesses. As he stated, the case file was sent to him (prosecutor) a while ago for prosecution from Bakau Police Station.
The adjudicating Magistrate, in his ruling, granted the application made by the prosecution and further granted the accused persons court bail in the sum of D10, 000 and one surety with Gambian Identity Card who should be residing within the Greater Banjul area.
The case is expected to continue on 28th October 2009.

Toubab, you pull out some of the craziest stories out there. I think this is a waste of the court's and law enforcement time; they should just legalize but regulate the trade and make them pay taxes like all "small business owners."

Thanks Toubab. Like you rightly said, I am not an attorney and I am far from familiar with Gambian law. However, in general a "vagabond" means a homeless person, a drifter-one who is constantly travelling. It is synonymous to 'tramp' and 'rogue'. I think in this case, the word is used as a code-word for 'prostitution' and 'soliciting commercial sex'. While soliciting money and sex may be offenses in many countries including almost all states in the U.S. except Nevada(Las Vegas the so-called Sin City), this case appears to have no merit at all. It is difficult to imagine 35 girls converging on the same highway to solicit sex. The prosecution will perhaps also have to prove if actual solicitation or sex-for-money occured. Where on Bertil Harding Highway were the girls picked up? Who did they solicit from? Was this a 'sting operation' involving an undercover cop? Are there physical evidence seized from the girls that points to prostitution? Without these questions (and more) answered beyond reasonable doubt, it is likely the case will be dismissed...

Nah Moe, I'm not a pervert; you confessed to knowing all the streets... and I'm not surprised that you were a regular there at a very tender age Now you know why i believe that the industry should be regulated!
I'm just a fiscal conservative who does not believe that government should have a say in what consenting adults do .
Btw, do you have a google map link to the streets you just mentioned? |

Thanks Prince,you can never stop the conduct that is implied by the newspaper,you may think it bad,imoral,or whatever, the Court system is the only avenue to deal with this conduct.Africa is begining to be persuaded that women are people and not property ,therefore they can make up their own minds how they conduct themselves.I think regulation would not work,by the nature of the activity it is somewhat secret,however having legalised brothels where the activity could be supervised may be an idea,there again such activity as the women are alleged to have been involved in has always been associated with criminal and drugs. All in all leave things as they are,if you move these women from one area they will start in an other area.I regret there is no answer.

what is new here , exactly? they do this regularly and always have. it is primarily a way to take a few bribes and pay for their breakfasts. the girls will be back there the next night. why is it even in the papers? answer - to make a show that the morally upstanding gambian police force are seen to be dealing with such heinous crimes as solicitation- which lets face it, is much worse than policeman taking bribes or journalists being killed. aha! |

| it seems strange to name the people involved, i cannot imagine that there were standing on the side of the highway, waiting for customers, that is nto the gambia I know, if they had been arrested in a club or senegambia area, then maybe, it still seems a lot of people. |

He some how managed to convince me but are you down for legislation toubab ,atleast we will get taxes in return for the services provided and they can be subjected to routine Hiv sexually transmitted diseases ,their retirement goes in effect with them being infested and diagnosed with a sexually transmitted disease. I thank you for your explanation and that would of been enough but you all ways have to have a dig or make some adverse comment or insult people. what a way to go thru life. I think its very sad. At the end of all your posting you use the word Peace with your aggressive stance toward people on Bantaba I dont think you know the meaning of the word NO IM NOT PLANNING TO GO THERE (The Brothels) or indeed ever go back to Gambia its not what it was As I have said befor this winter in Novemer Im going to America then Australia,New Zealand then Thailand, India back to the Uk April. Do you go to these places to visit family or friends or as a tourist? Do you travel with family or a partner or alone?
Do you do any charity in any of these places?
Gambia and it's people really touched my heart, but I haven't been for two years and I am not sure when I will return. I miss it, but the world is getting smaller and there are lots of other places to visit that are equally interesting to me...... |
