Jambur Land Dispute Trial
Accused Persons Discharged

Senior Magistrate E.F M’bai of the Brikama Magistrates’ Court, on Tuesday, 18 March, 2008 discharged eighteen people who were charged with trespassing on a disputed piece of land, located at Jambur, in  Kombo South, for lack of jurisdiction.
During the sitting on 6 February, counsel for the accused persons, Lawyer Borry Touray submitted that the Brikama Magistrates Court is incompetent and lacks jurisdiction to proceed with the case. Lawyer Touray noted that a civil action for the determination of ownership of the disputed piece of land is filed at the Brikama High Court.
In his reply, the prosecutor Corporal 134 Sambou noted that the accused persons have failed to heed to the order of the High Court that urged them to refrain from interfering with the disputed piece of land.
In his ruling, the presiding Magistrate noted that the accused persons are charged with criminal trespass on a disputed piece of land whose ownership is yet to be determined. Magistrate M’bai reiterated that a civil suit determining ownership of the said land is pending at the High Court.
He said it is for the High Court to take appropriate action on the failure of the accused persons to heed to its order to desist from interfering with the said land. Magistrate M’bai noted that his court lacks jurisdiction to entertain such a matter and accordingly discharged the eighteen persons.
The discharged persons are Ansumana Jammeh, Lamin S. Bojang, Amadou Bojang, Ousman Bojang, Bubacarr Bojang, Alieu Saine, Muhamed Bojang, Buba Bojang, Lamin C. Bojang, Lamin K. Bojang, Ebou Njie, Abdoulie Touray, Alasan Bojang, Abdoulie Bojang, Omar Bojang, Mbemba Fadera and Musa Bojang.

The Release of Jalambang Alkalo and the Demolition Exercise

Foroyaa is reliably informed of a demolition exercise that took place at Jalambang and the arrest of the Alkalo of Jalambang. Jalambang is located in Kombo Central and shares a border with Jambur village in Kombo South. This reporter went there to confirm the story. Alh Njobo Bah the Alkalo of Jalambang, when approached by this reporter confirmed his recent arrest by some security personnel. In his narration, the Alkalo explained that on Wednesday 9th December 2009 while he was on his way to the sitting of the district tribunal in Brikama, he was confronted by some people who identified themselves as state security personnel who invited him to join their vehicle and accompany them to the land belonging to the president. He said he was driven by them to the said land and then to the governor’s office in Brikama from where they drove him to Jambur and finally to the NIA Headquarters in Banjul. According to him, at the NIA Headquarters he was asked whether he is the one who allocated plots of land to people in the said land knowing full well that the land belongs to the head of state. According to him he told them that he was never aware that the said land belongs to the president and has never been informed of that fact by any one.
Alkalo Bah said he informed the officers that he has no ill intention against the Head of State and would never give any property away knowing that it belongs to the head of state. He said that he indicated to them that he was once asked to inform all those who have obtained plots in the area to vacate the place which he said he did. According to Mr. Bah, he spent two days at the NIA Headquarters and was later released on bail, and has now been asked to be reporting on bail.

The Demolition
This reporter observed that all structures, including fences which were erected in the area have been demolished. When the Alkalo was asked about his opinion on the demolition exercise he said that he has no opinion to express. He told this reporter that the area in question is between his village and the village of Jambur. He said Jambur has claimed ownership of the land and they have allocated it to the Head of State. He said those whose structures were demolished should understand that that is what happened. Our readers would recall that our reporter visited the Alkalo of Jambur who also claimed that the land was allocated to the Head of State by the “Santang Jubaa Kabilo” of his village and they have been cultivating crops on the land for the past years for the president.

Editor’s Note
There is thorough confusion regarding the system of land ownership in the country especially in the Kombos. People are acquiring land from people who are accepted as the traditional heads of villages but in many instances some of these village heads are ceremonial heads. When it comes to land ownership others are claiming ownership of the very land on which such villages are established. Many people have invested their life savings to purchase land only to discover that it has been sold to other people or given away. The office of the President has been featuring with regards to the Land at Jalambang. Our reporter did go to the Physical planning office for clarification but was referred to the Minister for Local Government and Lands. The Office of the President should know that many people who had plots at Jalambang are concerned and would want the protection of the state so that they would not lose their life time savings. There is need for public inquiry to be able to expose what went wrong and what the state intends to do to provide redress. Our reporter will pursue the matter with the Minister.
