Fatou Jaw's case dragging still

The latest from Banjul on Fatou Jaw's case is worrying. Sometimes you wonder what to do. Do we scream just to attract a crowd or do we just fold our hands and watch a show. Neither of them will work. But according to an authentic naration of the noble Prophet Muhammad (PBUH), if a person sees a bad deed, you should remove it with your hand. Where you cannot with the hand, you should openly criticise it. Where you cannot by criticism, you should hate it and be silent, the weakest state one can get.

So what do we do fellows? Tell me!

Do we climb the mountains to rescue her or do we cross the deepest rivers?? Tell me!

Please remember her in your prayers.

Yero, Fatou's case is really very unfortunate and upsetting. There are lot of things we can do to help, but sometimes perception hinders our efforts to help people in situation like she is in.

We have offered to colaborate with her current school which she was attending in the U.S to spread the world through the educational institution and the student government or human rights action possibly upto the U.S congress but we were asked to hold on for reasons not explained to us.

The case is very serious and we could certainly put the government back on the spotlight again by contacting influential people. I know someone was suppose to contact people like Jesse Jackson but no results. Sometimes we Gambians have problems of following through our promises. Talk is cheap and actions of course speak louder than words. Am with you my brother it is frustrating..

It is certainly not too late for us to continue to do something...

I am a living testimony to your efforts and mention. Thanks for bringing it up. & thanks for your big-heart always. In fact , the reason why i asked, I am clipped in similar caliphers, so what do we do then.

The reason I never talk about Fatou is my heart alway aches when I think of her situation.We appriciate all the efforts collegues are doing to raise awareness both to her school and any one who could be of influence in the US.

As some one rightly said, Gambian nature is more talking behind dark curtains and never brave enough to came out to be seen.

I belief if those in the US raised the noice about Fatou, or even the paper she used to write for. goes out to media outlets in the US or even the Gambia embasy and trying some American Media /news out lets like CNN ect to cover the demonstration, someone will pick the message up so that next time if you request seing someone you will be remembered.

AN OPEN LETTER TO JUSTICE MABEL YAMUA
In the matter of Ms. Jaw-Manneh vs. the Jammeh administration.

Honorable Judge,
I write from the far not to beg for mercy or interfere with Ms.Jaw-Manneh’s case while it is a matter under the jurisdiction of your court, but I write to ask your honor to observe due diligence on the ongoing matter. This would include acquitting the case since the matter under observation was placed before many judges who couldn’t preside over it because the case is “out of their jurisdiction.” That goes a long way telling us that the crime for which she was charged was not there, and in essence she is ‘innocent.’ Therefore, in the interest of true justice, it is only fair that she is acquitted in this long-dragging snail case.

Honorable Judge,
Imagine a world with leaders whose followers cannot have freedom of expression. Imagine a world where the oppressed cannot drop tears. Imagine a world where the sworn Judges cannot make independent decisions. Imagine a world where political and human rights activists are continually subjected to killing and jailing. The list goes on and on. As citizens of the Gambia, we are entitled to our freedom and liberty. That freedom further empowers us to criticize those leaders of ours whose actions don’t conform to the Gambian constitution. From the president down to lowest civil servant cannot be immune from public scrutiny and criticism; hence their earning is from Gambia’s coffers. It goes a long way saying that leaders are supposed to be humble servants of the people. Leaders cannot turn their angry swords towards the innocent citizenry because it is certain they are far from being enemies of the state.

Honorable Judge,
“Justice delayed is justice denied.” Ms. Jaw-Manneh was arrested since March 28th 2007, and since then her case has been delayed by randomly moving it from one court to another, notably from Magistrate Buba Jawo to Magistrate Imelda Mboto and finally to your court- Your honor Justice Yamua .It is obvious that the state has an interest in the ongoing trial of Ms Jaw-Manneh. The manner and nature of which she was arrested attest to the fact of notorious witch-hunting by the self-proclaimed NIA thugs. But for the fact of a constructive argument, the Gambian National Anthem summed it all when it read “Let justice guide our actions.” That justice must be true justice. It shouldn’t be faked justice where those in power witch-hunt their critics while hiding under the cover of justice. It is a shame to that twisted justice. Ms Jaw-Manneh is also a graduate student, a promising public asset, whose activities in the past clearly showed conscience of true democracy.

Honorable Justice,
On May 19th 2007, Gainako’s co-editor and political commentator Mr. Demba Baldeh in an editorial argued thus:

“The presiding magistrate must understand that while Fatou's case is one among many, it has unique historic significant in the administration of justice in the Gambia. While regimes and judges come and go, heroic administration of justice or lack thereof will always be recorded in the history books similar to the numerous civil rights cases defended by brave lawyers like Jonnie Cochran.”

It is important to note that history is in the making, therefore let history record in full of what is under observation. In another articulate observation, the defensive editor Baldeh questioned the presiding Magistrate at the time, Buba Jawo thus:

“Finally, at the conclusion of the trial and in delivering the verdict, Magistrate Jawo must allow his conscience to dictate what is right. He must render his verdict by answering the following questions. Does the constitution of the Gambia clearly guarantee the freedom of speech and expression of citizens? If yes, then you must acquit. Does criticizing the President in his service to the nation a democratic state constitute sedition? If no, then you must acquit. Does the prosecution's witness - the NIA agents, violate Fatou's right to access legal counsel before taking her statement? If yes, then you must acquit Fatou Sir.”

Therefore, honorable Justice Yamou, I am directing the same write-up to your court with the hope that you will finally acquit the case. It is not in my doubt that acquitting her might cost you your job, but that the oath you took to protect justice you must never betray or belie. While the case is spineless, it is prudent that such a case should be acquitted forthwith without delay. It should be an example to the spiteful prosecutors whose whims and caprices continually capitalized on entrusted state power to silent innocent citizens arrogantly without due respect to law. Guardians of the law must render justice without fear or favor. By acquitting this case, you would be setting a record. History will cherish you for ever. The basis under which I am arguing for acquittal of the case is that the case doesn’t have merits for prosecution, i.e. to say that the charges don’t exist. Secondly, Ms Jaw-Manneh is of good moral character and openly supported democratic means of governance. She is also a good mother, a successful Gambian woman yearning for beneficial education beyond undergraduate level.

I also take this opportunity to call on the Imam-ratib of Banjul, Gambia’s SOS for justice, and the diplomatic core representatives in the Gambia notably the US, British and other ambassadors to interfere with full support of justice. Private individuals and the international community should rise up and know “injustice to Gambians is injustice to others.” The effort by the Media Foundation for West Africa based in Ghana is worth emulating. They have succeeded in launching full support for justice by their petition of justice for Chief Ebrima Manneh. That trend must continue in other directions of human rights abuses. In the end we conclude by saying repeating Gandhi’s words, thus “When I despair, I remember that throughout history, the way of truth and love has always won. There have been tyrants and murderers; and for a time they can seem invincible, but in the end, they always fall.”

Honorable Justice Yamua, thank you for giving this letter the respect it deserves.

Justice & Uncle Santa;

Both of you are running melody tones.

For a fact, the truth remains the interest groups in Washington and London especially are mere hypocrites. That is certainly a tag I am ready to walk to the streets with.

Having said that, we still should engage them for uniformity. We just have to be careful with dealings everywhere.

As for Fatou, Lets see how her Dec. 7th appearance before Justice Yamua will look like. According what I heard she tend to favor Justice a lot. She is a Common Wealth Judge, therefore she does her herding different from the others. It was just news that the other *****-Justice Paul was on his heels. There is no better news to digest than that.

Justice M A Paul who served as a judge in The Gambia judiciary for many years is said to have gone
on leave and refused to come back.

According to information, Justice Paul left The Gambia when the whole High Court went on leave in
August this year. It was also believed by some that the controversial judge went on leave to the UK
where he get a job and therefore flouted the contract he made with the Gambia Government.
The judge is seen by many as notorious and for some as corrupt. Notorious because he has jailed
many opposition personalities including veteran politicians such as Lamin Waa Juwara for a flimsy
sedition charge and detained Halifa Sallah, Omar Jallow and Hamat NK Bah for simply saying that
they fear, they may not have an impartial and fair trial so they do not want him to try them. This made
him furious to the extend that he did not only refused request of the accused to be tried by another
judge but also refused bail and sent the three to remand in the notorious mile two prison.
Justice M A Paul was also despised by many because as chair person of the anti-corruption
commission set up by the president to probe past and present civil servants who served the
AFPRC/APRC government rescued him self from one Lang Conteh’s case after the commission
made adverse findings against the latter, surprised many people when he told Halifa Sallah and co. that
throughout his career he had never learned of an accused deciding who should try him.

By end of 2005, the controversial Nigerian judge who was himself embroiled in a corruption scandal
until the National Assembly had to investigate the allegations that he as chair person made under
handed deals relating to sale of AMRC properties and so on, could hardly have any body accepting
trial under him. He was later transferred to the court of Appeal before his leave in 2007.

However, sources disclosed that M A Paul has gone for good which they received with joy because
they believe that he is one of the surrogate type of judges who simply serve the desire of dictatorial
regimes in Africa. This is why his abscendence makes news.

mr justice ,be rest assured that i am not the subject of any discussion here.where ever in the whole wide world i take my breath is not your little business .stop using the igonrant childish method of declearing your patriototism by your being in the gambia.i was just came back from the gambia last week brother.be in the gambia or in the moon that doesn't matter.
now coming to the issue at hand ,i NEVER supported any actions by the united states government NOT once .but if we cry infront of our equals all the time what RESPECT are we to gain from that? please tell me .the reason why the west continue to do what they do to us is because we always like opening our loud mouth crying and blaming ,what are you going to do about the aggressions of the u.s? we have heard you over and over on the genoside,mass murder etc etc ,yes even some americans accept that ,but talking about it only will not stop it ,what is your good plan commander ?

Santanfara,am not bragging that am patriotic or whatever.You attacked me for saying the plain truth about the west especially the United States.I have no business,of where ever you want to be in this world.Offcourse, if you say that,what am saying about them makes them great, that implies your support for their criminality.I Can`t do anything,about the USA agressions, but those who are victims of the USA agressions are doing something about it.I never said that all Americans are bad people.Cmon Santanfara, dont distort my points.I point at the USA based on the open letter written by Dalton on behave of Fatou Jaw Manneh to USA govt.I don`t need to be credited by people who don`t have sense of directions.Not at all.I never claim to be more Gambian than you, tribalism never part of me.Who cares if you live in the West?Actually not me!

Justice Yamoa had three options;

(I) To acquit the case

(II) To hear a preliminary and set it for final hearing

(III) To get the case back to the courts.



In her ruling, she chose to get it back to the courts. It is a shame to justice. It clearly shows the state has an interest in it. The presiding judges are sandwiched in-between walls of fears. If they deliver true justice, they risk loosing their jobs. If they follow the orders of the state (Jammeh), they risk being haunted by history for failing an oath of justice. If they return the case back to the courts, they have succeeded in covering their butts from both misfortunes. It is obvious that the *****ic justice Paul on his heels would have done the damage. The moves by these judges to refuse being used as farm tools are a step in the right direction.

Then what can we do?

We should all answer the “call” to equip Fatou’s defense. In the end, it is only true justice that will come out of it. Obviously the secrete efforts by the *****cats for kneel-down before the he-goat criminal ruler as a way of relinquishing the case under the covers of “bari-doleh borom granbubah buh rei balan nakoh” is no option to go with.

What is obvious to all, they succeeded in wasting her time. The worst disease that can affect one is being denied justice. If not for the stress and frustration that they put her true, they also succeeded in taming her against her will. "Justice delayed is justice denied.'
