Adjourned until 9th October by the Magistrate Amie Jagne ,who maybe hopes that all parties can sort out their differences,reading this very confusing and unclear article (Not the Reporters fault at all he has done a good job reporting) The whole thing dosn't ring true at all, even the lawyer is making very lame excuses why he could not be in court to do his job.

Tussle Over Occupancy of House Lands In -Laws in Court

A German National, Inyolf Buchheister, (alias Babucarr Bojang); a resident of Kafuta village in the Kombo East Constituency, dragged his in-laws to court for denying him access to his compound. He built the house and was staying there with his wife and 3 children before leaving for Germany. Mr. Jerry Kujabi, the first defendant and his wife Halimatou Colley, the second defendant were asked to cross-examine the complainant, Babucarr Bojang, after the court stood down for more than two hours.
When the case was called initially, the police prosecutor, Chief Inspector Lamin Touray announced his appearance for the Inspector General of Police, whilst the duo said their counsel is on his way to the court. Magistrate Amie Jagne asked the court to stand down for 45 minutes to allow the counsel of the two accused persons’ to arrive. The magistrate asked the accused persons to cross-examine the complainant as they were waiting for their counsel who they hope would be in court.
The duo later told the court that their counsel told them that he was on a meeting and he could not make it to court. The magistrate reminded the first accused person that he was on oath and asked him to cross-examine the complainant. The first accused person, Mr. Jerry Kujabi, asked the complainant how they entered into his compound, the complainant said he does not know; that he just found them there.
The first accused person again asked him whose daughter he has married, the complainant replied that he married their daughter. Mr. Jerry Kujabi further asked his son in law (Babucarr Bojang) whether it is because of him and their daughter that they are in his compound.
Inyolf Buchheister responded that it is not because of him that they are in his compound; adding he has told them to leave his compound and they refused to do so. Mr. Jerry Kujabi in his cross-examination told the court that it is the complainant who told his wife (his daughter) to tell them (Mr. Jerry Kujabi and Madam Kujabi) to come and stay in his compound.
The complainant (son in law) replied that that is not true. The first accused person asked his son in law the reason why he asked their lawyer to appeal to them; that he wanted to withdraw the case from the court for them to reconcile because they are his in-laws. The complainant replied that he never wanted to withdraw the case. Mr. Jerry Kujabi further puts it to the complainant that he had bought cola nut and got to their family and they told him that the issue is finished now and that he could go back to his compound. The witness replied that he bought that cola nut so that he could see his children.
“I never told them that I will reconcile with them and they never told me to come back to my compound,” said the complainant. The first accused person asked the complainant whether his children are with him, the complainant replied that he has not seen his children for two years. The first accused person said, “You took your wife and children to Germany since then, we did not see them.” He added, “we are not staying in the compound. You can entrust it to someone, anytime you want to move in to your compound you can do so.” The complainant stated that they forcefully took him out of his compound.
“In fact I don’t know who is there.” He said. The magistrate asked the second accused person Halimatou Colley to cross-examine the complainant in the next adjourned date. The first accused person who is the husband to the second accused person said he has already spoken and that is enough for both of them. He said whatever he told the court, the wife would go by that.
The presiding magistrate, Amie Jagne, puts it to the first accused person, Mr Jerry Kujabi, that both of them have different names and that he did not bring his wife to court. The case is adjourned till 9 October 2013.
