A much fairer way in Gambia's situation would be an enforceable law only allowing publication of the above details after the first court appearance. |

Sab,I am no lawyer,but in law I do know that the detail is in the fine print and the words used in the drafting of laws,that is why lawyers nit pick and get things dismissed over technicalities,you may remember that there was a case sometime ago (I cannot remember the details) where the whole case hinged on weather there was a ? at the end of a sentence or not,it would be good if the legal eagles that used to read bantaba (do they still visit ?) could isolate the relevant written section from The Laws of The Gambia (The new and up to date edition of course ) and copy and paste them here,then we can all discuss that which we all hope applies really does apply.

It is not only Government news media but it is common that the private media also publish details of arrested persons. |

OK,so let's go down the route of assuming that it's illegal,and that government and private media are breaking the Laws of the Gambia,what then ? it is obvious that this has become an accepted practice and that NO ONE IN THE GAMBIA is going to do anything about it,in that case,assuming that defendants affected do not wish to TRY to take Court action what can be done? Is the world outside concerned ? We can discuss these questions at length but the final result will be the same. |
