Although the alkalo was old (see judges comments) he has swindled people out of their money by virtue of his office and defrauded the administration of tax revenue,this leaves the way open for those people who he had swindled to sue him for the amount that they paid him,that he will not be able to afford I suspect,what will happen then, Mile 2 ?
As usual with all governments they win and get their money first.

Should we feel sorry for this old thief ?

Justice Emmanuel A. Nkea of the High Court in Banjul has convicted Alkalo Malamin Kala Bojang, the Alkalo of Willinkama Village in the West Coast Region of economic crime.

The convict, Malamin Kala Bojang between the years 2006 and 2007 in Brufut, West Coast Region sold 25 plots of land to Momodou Lamin Jatta, Sherrif Kuyateh, Awa Kuyateh, Aja Amie Samba, Lamin Manjang at the rate of D1, 750, 000 and failed to pay capital gains tax thereon and thereby caused the loss of D262, 000 to The Gambia Revenue Authority (GRA).

In handing down judgment, the Judge disclosed that he was minded to hold the facts that the convict is a first offender who readily pleaded guilty as mitigating factors in his favour. The judge stated that it is evident that the convict has started remedying the loss caused to the state by making part payment of D90, 000, adding that it was the reason he would temper justice with mercy in passing sentence.

The judge pointed out that as he looked at the convict, he was already in the evening of his life and as he watched his demeanour he appeared to remorseful. The judge stated that he would not impose a mandatory jail term on him, and therefore sentenced him as follows: 1. That the convict, Malamin Kala Bojang shall pay a fine of D262, 500 less the sum of D90, 000, if it is shown or confirmed that the D90, 000 was paid in lieu of the amount on the charge sheet.

2. That in addition to the aforementioned sentence and pursuant to Section 6 (1) of the Economic Crimes (specified offence) Act, the convict shall pay a fine of D30, 000 or in default shall serve two years imprisonment with hard labour. 3. That the convict is given up to 30 days from the 9th of August 2011 to settle the fine under (1) above.

4. That the fine under (2) above to be paid forthwith. 5. Upon payment of (2) above, the convict shall be admitted to bail in the sum of D300, 000 and one surety in like sum who must have landed property in like sum within the Greater Banjul Area.
