Plea for Mitigation

I am really surprised that the Ikpala court didn’t find the convict mentally incompetent. While ‘murder’ is both unforgiveable and unforgettable, the court should have taken into consideration Hydara’s mental wellbeing. Having followed almost all the reportage on the court’s proceedings, I hope an appeal will be filed by his defense. The appellant in my view must petition among other things the man’s mental incompetence. It is without doubt I conclude from the man’s testimonial and lack of remorse that he suffered mental setback.

I extend my condolence to his late wife’s entire family. May her soul rest in perfect peace.

Thanks for your thoughts,whilst I understand what you have written, I think that Hydara is an elderly person who has thought about his situation very deeply and come to the conclusion that his life is finished and he does not wish to live anymore, he has convinced himself that in order to finish his life IN THE WAY THAT HE WANTS he has murdered people who are close to him,that is the way he has chosen to end his life knowing FULL WELL that the court could take NO OTHER COURSE of action than what it did.HE IS NOW CONTENT. He knows that due to his age he will die quite shortly in prison,that time spent in a Gambian prison is likely to be short due to the conditions that exist,he will have NO ONE at all to "assist" him in his prison condition,I think that he may well consider those conditions as punishment for his crime,and when that short time is past he will die and his body will go back to the earth.

Dalton,

I do not think that this guy had any mental inbalance whatsoever. I followed his trial, and could not even sensed that. He was enraged that proceeds from his orchad had been denied to him, and he saw that as 'inheretance before death' by his deceased wife and children. This, he could not sit and see continue, come what may.

He could have handled it better without resorting to what he did...sad, but he gets what he deserved.

To be honest, I have been hit by emotions. I understand where you guys are coming from on this. To me, the man's utterance is clearly not normal. Such abnormality constitute mental problems. Such utterances cannot come from a sane person. I think his defense should have him mentally evaluated.

You are obviously a very caring person and these circumstances have affected you a great deal,I feel that you may take some comfort from the fact that Hydara had made his own decision and that decision was one which very few of us would make.I take your point that his defence perhaps should have brought up his mental health in mitigation but as Hydara appears to be very strong will'd MAYBE he would not allow his mental state to be put forward in mitigation in discussions that he had with his legal team.

Gambia is not the only country where an elderly husband kills his wife,in this case he killed himself afterwards:

A 92-year-old man killed his 89-year-old wife before taking his own life, police have said.
The bodies of the pair were found by their son and daughter-in-law at 7.40pm on Friday at their home at Mint Dale in Kendal, Cumbria.
Police were called and post-mortem examinations carried out on Saturday.
Cumbria Police said inquiries are continuing but they have been able to establish that the man killed his wife before killing himself.
The exact cause of either of the deaths has not been disclosed.
Formal identification of the bodies has not yet taken place and the couple have not been named by police.
The local coroner has been informed.

Toubab,

Thanks for sharing. I believe a mental evaluation would have averted the double loss.

I followed a documentary about the gypies one time stating that if a were-wolf were to bite someone, that person also becomes a were-wolf and goes on the attack. I believe mental disorder is a serious matter always, resembling this mask. Once suffering from it, you are no more so yourself, and your actions become that of the devil. I ascertain the same thing for your forward, but I believe in many instances help is necessary to help all those in need.

It is with a thundering heart that I digest yet another sad murder case where an "alleged" lunatic axed a three-year old girl to death. With the rate at which it is happening, I think it becomes the responsibility of entire society, moreso Gov't to make sure these lunatics are taking off the streets for help. It is without doubt that these lunatics themselves needs serious help.
