The courts are taking an accused mental state into account,its a pity that care and treatment is not available easily,this is real progress .ALTHOUGH the prosecuting officer is I am sure no expert on mental illness and it would have been better if the accused had been examined by a qualified person,but I am also sure that the magistrate would make his own evaluation of the accused in court and form his own opinion.

A woman was recently discharged by the Kanifing Magistrates’ court, presided over by Magistrate Tabally, on mental ground.
The prosecuting officer, CPL 335 Nying, told the court that the accused, Fatoumata Ceesay, “is not mentally fit” to stand trial.
The charge sheet revealed that the accused, Fatoumata Ceesay, on 5 August 2010, at Old Jeshwang in the Kanifing Municipality, assaulted one Oumie Tamba, by biting her right ear and her right hand fingers, thereby causing her actual bodily harm. Author: Isatou Senghore
