Foroyaa has received information that Sarjo Jallow left Sweden on 22 August 2016 to come to The Gambia to fulfill his sarjo-jallowappointment as ‘Deputy Minister’ of Foreign Affairs with effect from 23 August 2016. Up to 2 September he moved about to carry out his own family duties. To the surprise of the family, it is reported that his residence was burgled on two occasions the latest being 1 September 2016 when a laptop got missing.

On the 2 September 2016 he spoke to a family member and discussed about the break in. Subsequently all calls were not received. Since 2 September Sarjo Jallow could not be reached. Family members have been trying to know his whereabouts.

What is proper for all family members to do is to go to the police stations within the jurisdiction of his residence, the police headquarters and the NIA headquarters to launch a complaint of his disappearance and further investigate whether it could be officially confirmed that he is under the custody of one of the security outfits.

His appointment was rescinded on 1 September 2016.

Defence counsel, DPP making efforts for release of Sarjo Jallow Says a close relative

Lawyer Antouman A.B. Gaye, defence counsel, and the Director of Public Prosecutions (DPP), are said to have intervened to secure the release of Mr. Momodousarjo-jallow Sarjo Jallow, the former deputy minister of foreign affairs, from the custody of the National Intelligence Agency (NIA), according to a close family source.

When the family of the detained former deputy minister was contacted for an update on Saturday, 5 November, the source told this reporter that Mr. Jallow is still being detained incommunicado at the NIA for 67 days. ‘‘We had met all the conditions that were requested but they told us that one thing is remaining which is his travelling documents and that one was stolen by unidentified men in civilian clothes,’’ disclosed the source.

The source stressed that the detention of their loved one is unlawful, adding that they have written to the Attorney General a few days ago requesting for an intervention but have not yet received any response. ‘‘Both his lawyer and the entire family members were denied access to him,” he further disclosed.

It could be recalled that family of Mr. Jallow, who was also a former ambassador of the Gambia to the AU, sued the state for his release. A motion was filed by Lawyer Antouman A.B Gaye, his counsel, seeking for an order to unconditionally release him from NIA headquarters in Banjul or grant him bail. On 17 October 2016, Justice Otaba of the Special Criminal Division of the High Court in Banjul granted bail to Mr. Sarjo Jallow in the sum of D200,000, with two Gambian sureties, with a property of the like sum. The trial judge also ordered for the accused person to submit his travelling documents to the Principal Registrar of the high court and for the sureties should swear to an affidavit of means.

It was earlier reported that Jallow’s travelling documents were also taken away by men who came to arrest him on Friday, 2 September, 2016 at his residence at Manjai Kunda.

His house, according to the wife, was burgled twice and that his personal laptop was taken away during the burglary.

However, at the time of going to press, efforts to reach his lawyer on the issue could not materialise.

SARJO JALLOW STILL DETAINED AFTER COURT ORDERS FOR HIS BAIL

The former minister of information, ambassador and lately a deputy minister of foreign affairs under the APRC regime is stillsarjo-jallow being held incommunicado at the National Intelligence Agency (NIA) headquarters in Banjul after the high court has already granted him bail.

Mr. Sarjo Jallow was arrested and held at the NIA since 2 September, 2016, by plainclothes officers at Manjai and denied access to his loved ones.

Lawyer Antouman A.B Gaye, counsel for Mr. Jallow, filed a motion seeking for an order to unconditionally release the applicant from NIA headquarters in Banjul or grant him bail.

In his ruling, Justice Otaba noted that the application was brought under section 19 of the constitution and section 99 of the Criminal Procedure Code, adding that in the affidavit, it is stated that since his arrest, the applicant has been held incommunicado and denied access to family and has not been charged or arraigned before a court of law. “He has not been released conditionally or unconditionally, and the reason for his arrest was not known,” he added.

Justice Otaba indicated that he shall exercise his discretion judicially and judiciously by granting bail to the applicant in the following terms. He, went on, “bail is granted to the applicant in the sum of D200,000 with two Gambian sureties, with a property of the like sum. The accused person must submit his travelling documents to the Principal Registrar of the high court and the sureties should swear to an affidavit of means.”

It was earlier reported that before his arrest, Mr. Jallow’s house was burgled for the second time with his laptop and travelling documents taken away.

According to a close family source, they were denied access to their loved one since his arrest 50 days ago. He added they have been making efforts to secure his release as the court has already granted him bail but still held by the authorities. “We were asked to bring his documents to the DPP (Director of Public Prosecution) but how can we produce his documents which were taken away by unknown intruders,” said the relative.

ACQUITTED AND DISCHARGED BUT STILL NOT FREE

Freedom is what a sovereign human being deserves. Every human being should be born free. His or her liberty should only be at stake if one is legitimately accused of committing a crime.

Accusation cannot be equated with guilt. This is why courts exist to receive evidence in order to determine innocence or guilt. Only the courts have powers to determine whether one who is accused of a crime is guilty or not.

This is precisely the reason why there is presumption of innocence until the guilt is proven or acknowledged by the accused out of his or her own volition.

Acquittal is a verdict delivered by a court. Why should a person acquitted and discharged by a court be arrested and forced to get bail just because the prosecution intends to appeal the verdict of a court. A person who is acquitted and discharged should be freed.

Hence any law which puts the liberty of a person at stake is one that needs to be repealed. This is the verdict of justice and common sense and incontrovertible.

Court rules in favour of detained ex-Deputy Minister

Justice O. Ottaba of the Special Criminal Division of the Banjul High Court yesterday ruled in favour of Momodou Sajo Jallow, the detained Ex-Deputy Foreign Affairs Minister, who was under NIA custody, and granted him bail of D200,000.


According to his lawyer A.A.B. Gaye, the applicant was detained by the NIA incommunicado and was not charged or brought to court, nor told why he was arrested and denied access to his family.

He has been under NIA custody for one month now.

Senior counsel Gaye then filed a motion, seeking an order to unconditionally release the applicant from NIA headquarters in Banjul on bail.

The applicant was arrested on 2 September 2016, by plainclothes officers at Manjai and detained at the NIA.

In his ruling, Justice Ottaba recalled that the application was brought under section 19 of the constitution and section 99 of the Criminal Procedure Code.

He said according to the affidavit, the applicant since his arrest had been held incommunicado and denied access to family and had not been charged or arraigned before a court of law.

He had not been released conditionally or unconditionally, and the reason for his arrest was not known.

Justice Ottaba held that he would exercise his discretion judicially and judiciously by granting bail to the applicant on the following terms:

Bail was granted to the applicant of D200,000 with two Gambian sureties, with a property.

The accused person must submit his travel documents to the principal registrar of the high court and the sureties should swear to an affidavit of means.
