If you want to live in a country then you must abide by the laws and established practices of that country that is especially applicable if the country is a country with different cultural values to those that you are familiar with in the country where you were born and grew up.
In any country you cannot tell the administration what to do.
It may well be that as Gambia is a developing country in relation to the regularisation of land ownership that this court decision would be seen as a stated case and open the floodgates to a vast number of claims from non Gambians who wish to prove the ownership of the land that they at present hold and use.
"Public Relation Officer of the Gambia Immigration Department Cadet Inspector Saidou AM Bah on this issue through phone, and he said the matter is still under investigation."
Which is a clear statement,it may of course be a case of not joined up communication between government departments,we have to wait and see.

Reports have it that a German national, Bern Georg Diedrich, a successful plaintiff in aDiedrich land dispute is to be expelled from the Gambia by the Gambia Immigration authorities.
Diedrich who was evicted from his land by an executive order has been held by the Immigration at Tanji on Wednesday 14th January 2015. According to sources he has been asked to book a flight tomorrow, Friday 16 January, otherwise he would not be released to go back to his present residence at Busumbula.
Foroyaa has earlier reported the eviction of Bern Georg Diedrich and his Gambian Friend Alieu Barry from the land which a high court judgment has maintained is Diedrich’s property. Last month two officials, who said they were from the Physical Planning Department, accompanied by armed personnel from the Police Intervention Unit (PIU), demanded the keys of the said compound from Diedrich and Barry and then asked them to immediately vacate the place. Efforts were made to reach the Physical Planning and later the Permanent Secretary at the Ministry of Lands only said the decision to evict them from the land is an executive directive.
Foroyaa got in touch with the Public Relation Officer of the Gambia Immigration Department Cadet Inspector Saidou AM Bah on this issue through phone, and he said the matter is still under investigation.

While the government continues its mobilization of support to denounce those who use unconstitutional means to remove it from power, it continues to display all forms of unconstitutional behaviour.
In 2014 as in previous years there have been countless detentions without trial beyond the constitutional time limit of 72 hours. Section 19 subsection (3)(b) of the Constitution of the Republic of The Gambia stipulates that any person who is arrested or detained and “is not released, shall be brought without undue delay before a court and, in any event, within seventy-two hours.”
This provision has been treated with disregard in the past and is still being treated with disregard. As a consequence, many who have been picked up by men in plain clothes who claim to be from the NIA have simply gone out of sight. This is impunity.
Furthermore, the high court delivered judgment in favour of Bern Georg Diedrich, a German national who purchased land in Wullingkama, Kombo North District, and gave an order that no person should interfere with the land. On the contrary, the rule of might prevailed over the rule of law when officials from the physical planning department accompanied by PIU personnel evicted Mr. Diedrich from his land by executive order; while the Constitution, under Section 120(4) requires the Government and all departments and agencies of the Government to “accord such assistance to the courts as the courts may reasonably require to protect their independence, dignity and effectiveness.”
In short, for the government talk of unconstitutional behavior to gain credibility it must learn to behave in accordance with the Constitution and the Law.
It must release all those that have been detained contrary to the Constitution, particularly the relatives of suspects of the December 30 incident. It must also wash its hands off the Diedrich affair and leave litigants to battle it out in the courts. This is why courts are made independent of any person or authority as stated in Section 120(3) of the Constitution: “In the exercise of their judicial functions, the courts, the judges and other holders of judicial office shall be independent and shall be subject only to this Constitution and the law and, save as provided in this Chapter, shall not be subject to the control or direction of any other person or authority.”

Posted - 20 Jan 2015 : 16:42:20 Here is Foroyaa's take on this,IT IS ASSUMED THAT THE DEPORTATION WAS AS A RESULT OF THE HIGH COURT RULING.which may or may not be the case I note the words of the Immigration PRO,Seydou Bah, said: “The Director General of Immigration has the mandate to expel anybody out of the country who is subject to a deportation order."
AND
"For the German’s expulsion, I don’t have the specifics of the investigation which determined the reason for his deportation. Therefore, I am not going to speculate about that.” in his interview with The Point in the posting above. I am certain that this incident is far from finished,further information may well come to light.

German national expelled from Gambia africa » gambia Monday, January 19, 2015 Diplomatic sources have confirmed to The Point the deportation on Friday of Bern George Diedrich, a German national, who was living in The Gambia for several years.
The sources added that Mr Diedrich went to the German consulate in Banjul on Thursday to explain that he was informed by authorities to leave The Gambia on Friday 16 January 2015.
He also told the consulate that no official reason was given to him for his expulsion.
It would be noted that Mr Diedrich and his Gambian friend, Alieu Barry, were evicted last month from a compound whose matter was under litigation with a high court ruling in his favour.
When this paper contacted the Immigration Department to shed more light on the issue, the public relations officer, Seydou Bah, said: “The Director General of Immigration has the mandate to expel anybody out of the country who is subject to a deportation order.
“For the German’s expulsion, I don’t have the specifics of the investigation which determined the reason for his deportation. Therefore, I am not going to speculate about that.”
