I can visulise the unhappiness of the Judge in this case,have a read,
will he won't he ? I am sure that The Point will have a report on what happened at 1pm today when the case was called.
There is still an obvious disrespect for the Courts in GAmbia,witnesses apparently choosing to attend court or not,maybe a stay at the Hotel for a week would send a message on relaxation to others considering this prevalent course of action.

Judge unhappy with prosecution in former WAAPP coordinator trial

Justice Amadi of the Special Criminal Court Monday said he was not happy with the prosecution in the case involving the former coordinator of West Africa Productivity Project (WAAPP), Sheikh Tijan Sosseh.

When the case was called, the state counsel, M Mendy, said the state witness was out of the jurisdiction and asked for an adjournment.

Justice Amadi said they are wasting the court’s time.

He added that if he did adjourn the case to the next day and the witness did not show up, they would have to close their case or he would adjourn it to February next year or discharge the accused person until whenever they were ready to proceed with the case.

The state counsel then said the witness would appear in court today.

Since the prosecution said the witness would be in court Today, Justice Amadi adjourned the trial for 1pm on Tuesday.

This is becoming an ingrained practice,the courts APPEAR to be accepting this practice of being disrespected by the lawyers,maybe further training for lawyers in the administration of justice This report was in THE DAILY OBSERVER !!!

Absence of prosecution, witness hinder Lang Conteh’s trial

The criminal trial involving the state against Lang Conteh, the former managing director of Kanilai Family Farms (KFF), on Thursday failed to progress at the Banjul Magistrates’ Court before Magistrate Dawda A. Jallow.


The case that was set for continuation of hearing of a fresh witness could not proceed on the grounds that the prosecuting officer and its witness were not in court.


In response, the defence counsel, Lawyer LK Mboge stated; “Your worship can see from the records that the prosecution is granted three consecutive dates.” He stated that the prosecution is not in court to give any reason as to why they were not in court.


The defence lawyer thus applied for court to foreclose the prosecution’s case and allow the accused to open his defence stating; “Because this honorable court cannot wait for the witness, who has never showed up before this court”. He thus urged the court to grant his application for the interest of justice and fair hearing. The case was adjourned to 16th December 2014 at 1pm for ruling and continuation of hearing.

Does not look as though the State's witness did turn up,or did I miss that in the small print of The Point ?
I am a bit disappointed that The Point didn't think that it was important enough to report what happened ,speeches by anyone,comments by Justice Amadi,nothing,I really did think that The Point had turned the corner and was now reporting fully on newsworthy items,never mind; maybe they will in the future.
Attitudinal Change and the Work Ethic will take a long time to permeate all Gambian lives.
