State prosecutors led by the director of Public Prosecution Wednesday brought in more criminal charges against the embattled one-time secretary general, head of the Civil Service and Presidential Affairs minister, Momodou Sabally.
The charges, which have now jumped from three to eight, were brought before the High Court in Banjul, presided over by Justice Mikailu Abdulahi.
The multiple additional charges came in a form of an amendment to the previous charge sheet containing three counts.
When the matter came up, DPP S.H. Barkun made an application to amend the information earlier filed.
The DPP submitted that he was applying under section 218 of the Criminal Procedure Code which, he said, gives the right for the Attorney General to amend the charges in a trial; an application the defence counsel, Senior Lawyer Antouman Gaye didn’t object.
The presiding judge granted the DPP’s application and the amended eight counts criminal charges were read to the accused for his reaction given that the amendment affected all the earlier three counts.
Sabally is now charged with two counts of economic crimes: three counts of abuse of office; two neglect of official duty and a charge of giving false information to a public servant.
The prosecution alleged in count one that Momodou Sabally on or about the month of May 2014 at Banjul committed an offence to wit: while serving as SG, head of Civil Service and minister of Presidential Affairs caused economic loss to Social Security and Housing Finance Corporation (SSHFC) to the tune of four hundred and two thousand five hundred Dalasi (D402,500) by unduly influencing the said Corporation to fund a programme titled ‘Youth Career Development Programme’ organised by one Mariama Sillah without recourse to due process.
Count two of economic crime (specified offences) charge, prosecutors alleged that the accused sometime in May 2014 in Banjul committed an offence to wit: while serving as SG, head of Civil Service and minister of Presidential Affairs caused economic loss to the government of The Gambia to the tune of thirty eight thousand four hundred and twenty four dalasi (38,424:00) being money he received as per diem for a trip to South Africa in order to attend the inauguration ceremony of President Jacob Zuma, which he neglected to attend.
On count three of the abuse of offence, the particulars disclosed that he [Sabally] sometime in May 2014 in Banjul committed an offence to wit: in flagrant abuse of his office as the SG, head of Civil Service and Minister of Presidential Affairs influenced SSHFC to sponsor a programme titled ‘Youth Career Development Programme’, organised by one Mariama Sillah.
On count four, the particulars stated that the accused sometime in May 2014 in Banjul, committed an offence to wit; in flagrant abuse of his office as SG, head of Civil Service and minister of Presidential Affairs and blatant disregard of due process influenced SSHFC to sponsor a programmed titled “Youth Career Development Programme, organised by Mariama Ceesay.
Count five read that Momodou Sabally on or about 22nd day of May 2014 in Banjul committed an offence to wit; while serving as SG, head of Civil Service and minister of Presidential Affairs and while being part of The Gambian delegation to South Africa to attend the inauguration of President Jacob Zuma willfully neglected to attend the said inauguration.
On count six of abuse of office, the state claimed that Momodou Sabally sometime in May 2014 at Banjul committed an offence to wit: while serving as SG, head of Civil Service and Minister of Presidential Affairs. It further alleged that while being part of The Gambian delegation to South Africa to attend the inauguration of President Jacob Zuma, he willfully and negligently delayed the departure of the vice president’s flight from South Africa for 45 minutes and there by committed an offence.
On count seven, also abuse of office, the prosecutors further alleged that Sabally sometime in 2014 in Banjul committed an offence to wit: in flagrant abuse of his office as the SG, head of Civil Service and Minister of Presidential Affairs presented two vehicles being properties of Alassan Ndoye to His Excellency the President as a gift.
On the eighth and final count of giving false information to a public servant, it is alleged that Sabally sometime in 2014 in Banjul committed an offence to wit: in flagrant abuse of his office as SG, head of Civil Service and Minister of Presidential Affairs with intend to annoy and cause financial loss to Alassan Ndoye informed His Excellency the President that the said Alassan Ndoye had given two vehicle to His Excellency President; which information he knew or believed to be false.
Taking his plea, the accused denied all the charges pressed against him, prompting the DPP to apply for a date for hearing.
The defence then stood up and informed the court that there is a pending application for bail on behalf of the accused, but he was served with an affidavit in opposition while in the court just five minutes before the start of the proceeding and that as such, he wanted to react to the prosecution’s affidavit.
Subsequently the case was adjourned to Monday 27th October 2014 for continuation.

Posted - 23 Oct 2014 : 12:45:26 I would not presume to predict the outcome of this case ,it is MOST EVIDENT that an IN DEPTH FULL INVESTIGATION has taken place in order that the FULL evidence is presented to the trial judge,I only hope that the "lawyers" both defence and prosecution are FULLY COMPETENT to deal with this important trial,and that TOTALLY UNNECESSARY LEGAL DELAYING TACTICS are not allowed by the judge. |
