Former SG Sabally detained

According to reliable sources, Momodou Sabally, former Minister of Presidential Affairs, Secretary General and head of the civil service was detained by the state security agency for questioning.
No official reason was advanced to this paper.

The sources added that he was in custody since 8 July 2014.

It would be recalled that Mr Sabally joined the cabinet on 10 June last year as Minister of Presidential Affairs.

On 1st July 2014, he was transferred to Higher Education as Minister.
On 7 July 2014, he was removed from office.

At the time of going to press, it was not certain whether he was released or charged.

Sabally was also on 2 July 2014, removed as the Secretary General of the APRC party.

Sabally refuses to take plea

Momodou Sabally, the erstwhile Director General of The Gambia Radio and Television Services (GRTS), yesterday refused to take a plea before Justice E.O. Dada at the High Court in Banjul.

Sabally was indicted with 8 counts of a criminal charge and, when the matter came up, the accused informed the court that he had secured the services of a legal counsel who was engaged in another court.

The court clerk proceeded to read the 1st count in the charge sheet which stated economic crime, and the particulars of the offence disclosed that in the month of May 2014 in Banjul, whilst serving as the Secretary General and Minister of Presidential Affairs caused economic loss to Social Security and Housing Finance Corporation (SSHFC) to the tune of D402,500.00 by unduly influencing the said SSHFC to fund a programme titled ‘Youth Career Development Programme’ organised by one Mariama Sillah.

Asked about is his plea to the said count, Sabally replied that he did not intend to take a plea, as the state had filed a nolle prosecui in the matter.

At this point, presiding Judge Dada asked: did the state file a nolle prosecui? He told the court that it was in 2015.

State counsel A.M.Yusuf disclosed that a similar matter was before the court in 2015 and the state filed a nolle prosecui and the accused was discharged, but not acquitted.

State counsel Yusuf submitted that it is settled law that a matter, where a nolle prosecui was filed, is not barred from subsequent prosecution.

He urged the court to ask the accused to take his plea accordingly, noting that the matter before the court was a fresh bill of indictment, which was filed recently.

Justice E.O. Dada then adjourned the matter for today at 9.30a.m for ruling (whether Sabally is to take a plea or not).

Momodou Sabally, the erstwhile Director General of The Gambia Radio and Television services (GRTS), was yesterday arraigned before Justice E.O. Dada of the High Court in Banjul.

The matter was slated for plea-taking by the accused, but could not proceed as the court deemed it necessary for the accused to be represented by a legal counsel.

The former head of GRTS was arrested on 8 November 2016 and had been in detention until yesterday, when he was escorted by two security officers and led into the courtroom.

When the case was called, the accused entered the dock and the presiding Judge asked senior state counsel A.M. Yusuf if the state was having the bill of indictment, to which he replied in the affirmative.

She then turned to Sabally and asked him if he had a lawyer, and Sabally said he has no lawyer.

Justice Dada then asked the state counsel how did the accused know that he was coming to court.

Senior state counsel Yusuf replied that the state asked the security officers to bring him to court.

At this juncture, the presiding Judge ordered that the accused be served with the bill of indictment to enable him (the accused) prepare for his case.

The matter was then adjourned until 29 November 2016, for plea-taking.

It would be recalled that Momodou Sabally was arraigned and tried by the High Court in Banjul last year on charges of neglect of official duty, economic crime, among others.

The prosecution closed its case after calling ten witnesses and tendering exhibits to prove the charges against him.

He testified as a lone witness in his defence, but as the matter was set for judgment which was to be delivered by the then presiding judge, Emmanuel Amadi, the state filed a nolle prosecui to discontinue the trial, and Sabally was discharged.

State prosecutors, yesterday, re instituted charges against the former Director General of the Gambia Radio and Television Services [GRTS], Momodou Sabally, before Justice Otaba of the High Court in Banjul.

He did not take his plea and was given time in order to prepare and secure a legal counsel.

Sabally who was once appointed as the secretary general, head of civil servants and minister responsible for Presidential Affairs was charged with economic crime, negligect of official duties and false information in 2015 before his pardon and subsequent appointment as the managing director of Daily Observer and Director General of GRTS earlier this year.

He was on 30 October 2016 sacked, arrested and detained at the National Intelligence Agency in Banjul.

Sabally who was previously represented by lawyer Gaye is facing the same eight count charges ranging from two counts of economic crimes, three counts of abuse of office, two counts of negligence of official duty and a count of giving false information to a public officer, charges he denied.

Sabally pardoned, charges dropped

The Special Criminal Court in Banjul yesterday confirmed that they had received a letter from the Office of the President stating that President Yahya Jammeh had pardoned the former Secretary General, Momodou Sabally.

Momodou Sabally was indicted on an eight-count charge, which included economic crime, abuse of office, neglecting official duty and giving false information to a public servant.

The Special Criminal Court presided over by Justice Amadi had set 22 September 2015, as the date for judgment, but this was later deferred to 29 September 2015.

When the court clerk was approached about the judgment, she said “there will be no judgment on the case as we received a letter from State House that the accused was pardoned by the President.”

Sabally was first arraigned on 11 August 2014 before Justice Minkailu on a three-count charge of economic crime and abuse of office, which he denied.

On 22 October 2014, prosecutors filed an amended additional eight-count charge, which included economic crime, abuse of office, neglecting official duty and giving false information to a public servant, which he again denied.

Senior defence counsel Antouman Gaye filed a bail application before Justice Amadi of the Special Criminal Court in Banjul and was granted bail of D1.5 million on 25 November 2014.

During the trial, the prosecution led by the Director of Public Prosecution (DPP) Barkun, in trying to prove their case against the accused, called ten witnesses and tendered exhibits.

At the end of cross-examination of the tenth prosecution witness, Alassan Ndoye, the state announced closure of their case.

At the closure of the prosecution case, Sabally entered his defence and testified as a lone witness.

He has been granted bail,BUT will he be able to fulfill the conditions under which the Judge granted him bail, his own Recognisance of D1.5 Million and a surety in the same amount if these conditions cannot be met he will have to remain a guest at "The Hotel".

D1.5M bail bond for former SG Sabally

Justice Amadi of the Special Criminal Court in Banjul yesterday granted former Secretary General and Minister for Presidential Affairs Momodou Sabally bail of D1.5 million with one Gambian surety in like sum.
Sabally was also ordered to surrender all his travel documents to the court registrar.

Meanwhile, the surety should make sure that the accused person appears in court at every sitting to answer to the charges against him.

Justice Amadi also said henceforth the trial will be held once every working week, starting from 1 December 2014.

Sabally is facing an 8-count charge ranging from economic crimes, abuse of office, and negligence to giving false information.

Update on the whereabouts of former SG Sabally

The whereabouts of the former Head of Civil Service, Secretary General and Presidential Affairs Minister is still a mystery for family members. At the time of going to press, reports indicated that he has disappeared without trace after the termination of his very recent appointment as the Minister of Higher Education, Science, Research and Technology on 7th July, 2014.

According to the family, Momodou Sabally’s whereabouts is still unknown to them since his termination “we don’t know or have any information about Momodou Sabally after his appointment was terminated,” said a family source.

However, this reporter revisited his residence at Kotu on several occasions but the home was well secured by men in plain clothes. When this reporter approached the men in plain clothes and asked for Momodou Sabally and his wife, these men in plain clothes said Momodou Sabally is out of town and his wife went to work in Banjul. But when this reporter indicated that it was a Saturday, the men in plain clothes said she goes to work even on Sunday. The information that Mr Sabally was out of town contradicts well founded sources that indicate that he is with the NIA.

Readers would recall that in a previous edition, it was indicated that the situation was found to be tense and family members spoken to say they do not know the whereabouts of Mr Sabally. A large number of people, including relatives and sympathizers were seen around appearing to be in deep agony as they moved in and out.

Momodou Sabally who has been handling the position of Secretary General and Head of Civil Service and Minister of Presidential Affairs since June, 10th 2013, was relieved of his Cabinet post on July, 1st and moved to the Ministry of Higher Education, Research, Science and Technology.

The new release did not give any reasons (s) for his sudden removal. This new appointment was terminated a few days later.
