Dear Sir,

RE: RESIGNATION


Please kindly bring to the attention of the Judiciary Service Commission, my decision to resign as Judge of High Court and Acting Justice of Appeal of The Judiciary of The Gambia forthwith. And also note that, I will have to travel out of the country later today.

This decision is motivated in part, by my continuous failing health; for which I have had to consult severally in the recent past, and for other personal reasons. Kindly treat my accumulated leave days as the required period of notice.

2. Justice Emmanuel Nkea resigns


The main pillar of Jammeh’s judicial assault team, Justice Emmanuel Nkea, has tendered his resignation, effective immediately. No reason was given for the sudden and unexpected resignation, and none is being advanced at the moment.

The Cameroonian born judge of the Special Criminal Court who was on a two-week vacation, resumed duties a few days ago only to spring a surprise on a regime that it losing popular support because of high level corruption, general incompetence, and the use, or more appropriately, the abuse of the judiciary to put away its real and perceived political enemies. Justice Nkea has been an important part of that judicial team that Gambians have grown to despise.

During his two-week absence, speculation was rife that he was being whisked away by a regime that was increasingly under pressure because of its use of the judiciary to put away its opponents, and also because because of Nkea’s intimate involvement in this judicial scheme to deny Gambians their due process.

The Special Criminal Court judge was personally recruited by the former Solicitor general and close ally of the Gambian dictator, Ben Jammeh who has since fall afoul of the regime, and currently in exile in Senegal......

I am a student and was researching contempt and saw the paper delivered by Justice Nkea at the GPU last year and was surprised it was copied verbatim from the News Manual. He is so unscrupulous not even to acknowledge his source. This is what is called plagiarism, which is a criminal offence. A plagiarist is thief, so Justice Nkea is a thief who does not deserve to be a judge. He has no integrity.

2. Startling Revelations at Justice Wowo Trial By Rabiatou Jallow

The Special Criminal Court in Banjul was stunned into silence, shock and disbelief this afternoon 17 December 2013 when Justice Joseph Wowo continued his defence, with shocking revelations about the trial judge Justice Emmanuel Nkea. He specifically accused Nkea of corruption and greed for money.

Justice Joseph Wowo, who is standing trial on a multiple-count charge of abuse of office, told the stunned court that he would never get a fair trial in the hands of Justice Nkea.

“One of the charges against me is that I occupied the Office of Chief Justice illegally. The prosecution witness Belford has testified to that. He also testified that I renewed the contract of Justice Emmanuel Nkea, the sitting judge in my trial, when I was the acting Chief Justice of the Republic of The Gambia. If the prosecution says that I have a prima facie case to answer, then Justice Nkea has to step down as the trial judge in this case because I am going to call him as one of my witnesses in this case. He cannot be a judge and a witness at the same time.”

He continued: “Illegality cannot give birth to validity. If I occupied the Office of Chief Justice illegally then all the actions I took in that capacity are also illegal, including the renewal of Justice Nkea’s contract. It also follows that all the actions, decisions and judgments that Justice Nkea has taken since the renewal of his contract by a supposed illegal Chief Justice are null and void......

3. Justice Emmanuel Nkea is an Illegal Judge and a Chronic Liar (Part 1) By Modou Conteh

The dust is yet to settle in the landmark trial, conviction and sentencing of the erstwhile Chief Justice of The Gambia, Hon. Justice Joseph Wowo. However, the trial has thrown to light; many salient questions as to moral decadence that prevailing at the Judiciary of our dear country.

It could be recalled that during the trial of Justices Wowo and Jobarteh, the erstwhile Chief Justice made the following statements that were not challenged in open court; “One of the charges against me is that I occupied the Office of Chief Justice illegally.
