Malafi Jarju, the first class magistrate in Banjul has been appointed as coroner to inquire in the death of Louis Gomez, one of eight accused persons of the defunct NIA, and who was standing trail on several charges including murder.

Late Mr. Gomez was reported to have died at the Edward Francis Small Teaching Hospital.

Below reads the full release from the Office of the Chief Justice, Judiciary of The Gambia:

“The Hon. Chief Justice, Hon. Hassan B. Jallow, acting pursuant to the Coroner’s Act, Laws of The Gambia, has designated His Worship Mr. Malafi Jarju, First Class Magistrate in the City of Banjul, as Coroner to inquire in the death of Mr. Louise Gomez.

The late Mr. Gomez is reported to have died on the 11th of October, 2018 at the Edward Francis Small Teaching Hospital in the City of Banjul whilst detained on remand at the Mile 2 Central Prisons.

The Coroner will be conducting the Inquiry at the premises of the Banjul Magistrates Court.”

The Office of the President should issue a statement on the steps the government intends to take to get to the bottom of the cause and circumstances of the death of Louis Gomez in prison custody. The law is clear. Section 6(1) of the Coroners Act states:
“When a person dies while in the custody of the police or of a prison officer or in prison when detained in any place under the provisions of the Lunatics Detention Act, or of the criminal Procedure Code, the policer or prison officer or other person having the custody or charge of the deceased person at the time of his or her death shall immediately give notice of the death to the nearest Coroner and …… the Coroner shall hold an inquiry into the cause of death in the manner provided in this Act.”
The government should therefore declare that it will do what the law says and abide by the recommendations that emanates from any inquest or inquiry.

IN MY OPINION,I have not been able to find any information about how an inquest into the death of a person is set up in Gambia, is there a jury drawn at random from members of the public,are they paid expenses for food and travel whilst away from their homes on inquest hearings?
Is there ONLY ONE COMPETENT MAN gathering his own information into the cause and circumstances that lead to death ?

Dear Reader please give my questions above your urgent attention,I am sure that other casual visitors to Bantaba in Cyberspace would be interested,and maybe your research would assist Malafi Jarju.

Foroyaa has been reliably informed of a visit to the prison by the Coroner but a date is yet to be set for the inquiry to commence.

The paper is actively pursuing this matter. The clarion call of the new dispensation is never again. It is therefore important for the state to act with speed to get to the bottom of this matter and to carry out prison reform to ensure that a better environment is created for remand prisoners in particular and other prisoners in general. A government with integrity does justice to all and thus prevents actions that would tarnish its integrity.
