Justice Ebrima Jaiteh of the High Court in Banjul has declared that convicted prisoners have right to appeal and that right cannot be truncated because of administrative lapses, saying the trial should not stop at one stage or else The Gambia jurisprudence will not develop.

Justice Jaiteh made this declaration on Wednesday, 11th July 2018 whilst presiding over a criminal appeal matter involving one Gabriel Gaye and the State.

He noted that typing of records of proceedings at the Magistrates Courts is now becoming an obstruction to the course of justice.

The appellant, Gabriel Gaye was convicted and sentenced to eleven years imprisonment for the offence of possession of prohibited drugs for the purpose of trafficking contrary to sections 35 (1) and 43 (4) (e) of the Drug Control Act 2003.

Lawyer Kebba Sanyang, who informed the court that he was taking the case free of charge, pointed out that he was aware that the record of proceedings from the Magistrate’s Court has been transmitted to the High Court.

He informed the court that if the records of proceedings are typed, it would take a very long time for it to be completed and the case will take a long time to be heard.

Lawyer Sanyang assured the court that the appellant will photocopy the records of proceedings and therefore applied for the record of proceedings from the Magistrate’s Court to be photocopied so as to expedite the hearing of the matter.

He informed the court that following the service of the records of proceeding, he intends to file an amended petition on behalf of the appellant with the grounds of appeal.

He however sought leave of the court to amend the petition of appeal upon receipt of the record of proceedings.

Meanwhile the application was granted and the matter was adjourned to the 27th July 2018 for hearing.
