Justice Ebrima Jaiteh of the High Court in Banjul on 15 November 2017 ordered the State to produce the death certificate of Ebrima Sorri Jallow, who passed away in Tanka Tanka Psychiatric Hospital recently.
The accused person, Ebrima Sorri Jallow, was charged with a single count of child stealing contrary to the Criminal Code.
The prosecution alleged that the late accused person forcibly and fraudulently took away a two-year old boy (name withheld) from his parents on 10 December 2015, at Serekunda.
When the matter came up, the presiding Judge was informed that the accused person passed away at Tanka Tanka Hospital where he was receiving treatment.
After perusing the court file, the presiding Judge disclosed that the last time the matter came up before the court; the accused person was alleged to have been admitted at Tanka Tanka Hospital.
He informed the court that the late accused person’s death certificate was not before the court to ascertain the cause of death or whether the accused actually died.
Justice Ebrima Jaiteh then adjourned the matter until 17 November 2017 and ordered that the State furnish the court with the late accused person’s death certificate, adding that the production of the death certificate would facilitate making the necessary application for the withdrawal of the charge.
