CONFLICTING SIGNALS: ARRESTS AND DETENTION CONTINUE AFTER MASS PARDONING OF PRISONERS

When the president announced the pardoning of hundreds of prisoners, many Gambians were relieved. There was a joyful atmosphere and many believed the president was turning a new page.But the situation regarding arrests and detention give us a different signal. Impunity still prevails as the president threatens long jail terms. Arrests and detention without trial continue contrary to the requirement of the constitution that any detained person shall be brought before a court within 72 hours or be released with or without bail. Haruna Gassama, Seedy Jaiteh and Sheriff Faye are still held in detention beyond 72 hours without trial.
There has been no pronouncement regarding the disappearance of Chief Manneh, Haruna Jammeh, Masireh Jammeh, Modou Lamin Nyassi, Jasarja Kujabis, Buba Sanyang, the Americans, Lamin Tunkara and Kanyiba Kanyi, Omar Lowe, among others.
The media is still denied coverage of courts-martial, thereby keeping the public in the dark as to the fairness of the trial and contrary to constitutional requirements that court proceedings shall be held in public. Even finding out what the charges are from the armed forces headquarters is like searching for gold.
It goes without say no leader has moral authority to indict others of colonial domination and oppression if he/she deprives the people of freedom and rules with impunity.

SEEDY JAITEH HELD ALMOST ONE YEAR INCOMMUNICADO

Thursday, 27 August 2015, will mark exactly one year since Mr. Seedy Jaiteh, a former Human Resource Director of Gamtel/Gamcel, was picked up and later held incommunicado in the state central prison at Mile Two outside the capital city of Banjul.Mr. Jaiteh, who is being detained in contravention of section 19 of the Gambian Constitution, has not been taken before a court, according to a family source.

This father of one was reportedly picked up at his home in Manjai Kunda, apparently by operatives of the National Intelligence Agency (NIA), almost a year ago and subsequently detained until this day without access to family, friends and relatives.

The source explained that immediately after Mr. Jaiteh was abducted and whisked away in a numberless vehicle with tinted glasses, the family went searching for him at the different known detention centres such as the NIA, Police Headquarters, NDEA Holgam centre at Kanifing South and other police stations but in vain. He said their loved one was finally traced at the NIA in Banjul where they were initially allowed to be taking food to him but which lasted for only few days.

“Since the 3 September 2014 the family members have been denied access to him,” added the source.

It is also revealed that the family was highly optimistic that Mr. Jaiteh would be among those to be released by the President, as part of his mass pardon of convicted prisoners, but were disappointed that their loved was not after all reuniting with his family.

The source further indicated that the family is still appealing to the president to intervene and secure the release of Mr. Jaiteh in order to help end the trauma they have been subjected to since his arrest and detention.

SEEDY JAITEH STILL HELD INCOMMUNICADO FOR 700 DAYS WITHOUT TRIAL

Mr Seedy Jaiteh, a former Director of Human Resource at Gamtel/Gamcel, continues to languish in the Mile Two central prison for 700 days now without access to his family.

When contacted yesterday, Tuesday, 26 July, 2016 to enquire about his fate, a close family source confirmed to Foroyaa that he is still being held incommunicado at the central prison and not charged or brought before a court of law.

The family source indicated that they are deeply worried about this long and unlawful detention of their loved one who is also not allowed visits by his family members, adding that they have always been denied access by the prison guards when they make attempts to visit him.

The source renewed their incessant call for Mr. Jaiteh’s release to re-unite with his family.

Foroyaa has earlier reported that Mr. Jaiteh was arrested and detained since 2014.

It was also revealed that the former Gamtel/Gamcel official was first arrested in November 2010 at the National Intelligence Agency (NIA) headquarters in Banjul and held for many days before being released. He was said to be later arraigned before the high court and convicted on 20th October 2012 to serve a jail term and was released in February 2014.

A family source disclosed that Mr. Jaiteh was re-arrested by agents of NIA at his home in Manjai Kunda on 27 August 2014 and held briefly by them before he was eventually transferred on 3 September 2014 to Mile II prison where he is detained since then.
