I hope that this man is soon fit and well with all his facilities intact when he takes his place on the bench, it maybe however that his recovery may take some time and another magistrate has to be found to study the transcripts of the hearings that have gone before ably given I am sure by good lawyers and reliable witnesses,that maybe not possible so a fresh hearing before a new magistrate may be required.

Journalists’ trial suffers setback

The trial of two journalists, Musa Sheriff, editor-in-chief and publisher of The Voice newspaper, and Sainey M.K. Marenah, a freelance journalist, who were charged with conspiracy to cause a misdemeanour and publication of false news with intent to cause fear and alarm to the public, yesterday suffered another setback, at the Banjul Magistrates’ Court, before Magistrate Jackle Hackim.

The case, set for ruling on the no-case-to-answer submission made by the defence, could not proceed yesterday as the trial magistrate was reportedly ill.

Hearing continues on 10November 2014, for ruling.

Sainey M.K. Marena and Musa Sheriff are accused in count one that on 6 December 2013, in Banjul and diverse places, conspired to cause misdemeanorand published in the Voice newspaper medium a story headlined: “19 Green Youths Join the opposition UDP” dated 6 December 2013, and thereby committed an offence.

In count two, the two journalists were accused of knowing or having reason to believe that the said publication was likely to cause fear to the public or disturb the public peace, and thereby committed an offence.

Oh Dear Magistrates in the Gambia are falling sick here is another one :

"On at least two occasions, the ruling could not be made by Magistrate Tabally because he was indisposed."

This time is a Magistrate sitting at Kanifing,hope he recovers before the adjourned date of 20th November.
