The office of the director of public prosecution (DPP), has filed in a one-count criminal charge of official corruption against Ebrima Jah, a private legal practitioner before the Special Criminal Court in Banjul, presided over by Justice Emmanuel Amadi.

The prosecution alleged that the accused (Ebrima Jah) on or about 20th March 2014 at Banjul in the Banjul city council, whilst serving as counsel for the plaintiff in suit number HC/022/14/CO/006/D2 multi steel company LTD versus Omar Jasseh and another one pending before her ladyship Justice Awa Bah, offered the sum of one-hundred thousand dollars ($100, 000) which is equivalent to four million dalasi (D4, 000, 000) to the said judge in a bid to influence her to decide the case in his favor.

The case was set for mention to enable the accused take his plea, but it could not proceed as the accused was not in court, hence the state counsel A. Adeyemi was asked as to why the accused was not in court. Lawyer Jah Charged With Offering $100,000 to Justice Awa Bah

A single count charge of “Official Corruption” involving Barrister and Solicitor Ebrima Jah, was on Thursday 12th June, 2014 mentioned before Justice Emmanuel Amadi of the Special Criminal Court of the High Court of The Gambia.

According to the particulars of offence, the aforesaid person, on or about the 20th of March, 2014 at Banjul, Republic of the Gambia, within the jurisdiction of the court, whilst serving as counsel for the plaintiff in suit number HC/022/14/Co/006/D2 Multi Steel Company Limited Vs Omar Jasseh and Another before Honourable Justice Awa Bah “offered the sum of one hundred thousand U.S Dollar (US$100,000.00) equivalent to (D4,000,000.00) to the said honourable Justice Awa Bah in your bid to influence her to decide the case in your favour and thereby committed an offence.”

When the case was called for mention and plea taking, the accused was not present in court nor was he represented by counsel. State counsel Mrs. Amenchi Adeyemi informed the court that the accused was on police bail; adding that the matter was for mention but the state was not aware whether services were effected on the accused person.

“Since there is no proof of service, we are applying for adjournment and in case he (accused) fails to appear at the next adjourned date, we would make the necessary application,” she submitted.

However, the trial Judge indicated that the process server should produce affidavit of service of the accused person and consequently adjourned the matter to June 23rd, 2014.

Lawyer Jah absent for the second time

The case of Lawyer Ebrima Jah, a Gambian private legal practitioner, could not proceed yesterday, Monday, 23 June, before Justice Emmanuel Amadi of the Special Criminal Court of the Banjul High Court.

The matter was set for mention to allow the accused, Lawyer Jah, to take his plea, but the case could not proceed for the second time as the accused was not in court.

During the previous sitting, the state prosecutor told the court that the accused was on police bail and was not sure whether he was served with a notice which has prompted the judge to adjourn the case. He ordered for the court server to serve the accused with a notice to appear before him in the next sitting.

Information emanating from the court has it that the prosecution is planning to reach the police to contact the sureties of the accused person as the prosecutor said in the last sitting (Thursday) that they would make the necessary applications if the accused fails to appear in the next sitting (yesterday).

Meanwhile, ASP David Kujabi, the police spokesperson, when contacted on the matter, said he was not aware whether the court has notified the police about the sureties of the accused person. He said he would need time to find out but could not be reached at the time of going to press.

The Director of Public Prosecutions (DPP) SH Barkun and Lawyer Hawa Sisay Sabally yesterday, Thursday 3rd July, were engaged in legal tussle on the forfeiture of D1 Million bail bond against the sureties of Lawyer Ebrima Jah, who has jumped bail after his release from police custody.

Lawyer Ebrima Jah, a Gambian private legal practitioner was charged with official corruption before Justice Emmanuel Amadi of the Special Criminal Court at the Banjul High Court. The matter was set for mention to allow the accused, Lawyer Jah, to take his plea but the case could not proceed on three consecutive times because the accused did not show up in court.

The prosecution vowed to make the necessary application if the accused failed to appear. Therefore, the prosecutors filed an application to forfeit the bond against Abdoulie Jah and Ebrima Jobe, the two sureties of Lawyer Jah.

The Director of Public Prosecutions said from all indications, the accused has jumped bail and the respondents are in better position to know the whereabouts of the accused since they were the sureties.

“If they cannot produce the accused they should forfeit the bail bond which they have entered,” he told the court......Full Report

WRONG AGAIN PLEASE SEE CORRECT INTERPRETATION IN LATER POSTING BY AN EXPERT,SORRY

If the Court does decide to estreat monies from Abdoulie Jah and Ebrima Jobe they MAY have a problem finding such a large sum,a reminder that PROMISES made MUST be kept.

My friend, they are saying that the DPP misrepresented the terms and conditions of the bond and that it was tempered with after it was already signed.
