1. 2 GPA officials acquitted on all charges

Magistrate Lamin Mbaye of the Banjul Magistrates’ Court, has dismissed and acquitted two top officials of the Gambia Ports Authority, namely Hali Abdoulie Gai and Abdoulie Tambedou, the former financial director and ex-managing director of the same institution, on all charges leveled against them.
Delivering a ruling on no-case-submission, filed by defence counsels for the accused persons namely, Lawyer L.S Camara, E. Singateh and E. Jah, the presiding Magistrate stated that the reason for the ruling was that the defence has made an application for the court to enter a ‘no-case-to-answer’ submission in favour of the accused persons, as per Section 166 of the Criminal Procedure Code.
“We have to be clear that the above didn't say the prosecution has to prove its case beyond doubt at this stage, it only has to prove the elements of the charge and issues in disputes at this stage of the trial. To fully understand the issues of ‘no-case-submission’ further, we look at the Gambia Court of Appeal case of Ceesay vs. Commissioner of Police (1960-1993) GLR110, as per Marcus Jones J.A in delivering the judgment of the court state that; as it is said the significant feature of the submission of ‘no-case’ is that it enables the defendant to defeat a prosecution when the crown is relying in important measure on admissions that may be extracted from the defence”.....

2. Ex-GPA Directors acquitted

The former finance director of the Gambia Ports Authority, Abdoulie Hali Gai, and Abdoulie Tambedou, the institution’s former managing director, were Monday acquitted and discharged by the Banjul Magistrates’ Court, presided over by Magistrate Lamin Mbaye.
They were acquitted and discharged on a five-count indictment which included two counts of neglect of official duty, and three counts of disobedience of statutory orders, following the no-case-to answer submission made by their counsel......
