These two women are among the most active in The Women's Rights Movement in The Gambia and had been a thorn in the flesh of both APRC and the traditional establishment.
For a united opposition, Dr. Isatou Touray has earlier been recommended as "not only qualified to lead a five-year interim NADD government, but also possessed the added merit of being a well educated social activist" and can be an Independent candidate living in The Gambia.

I wouldn’t be surprised if these charges are not politically motivated and in fact I find it unbelievable.

GAMCOTRAP top officials charged

Dr Isatou Touray Executive Director of the Gambia Committee on Traditional Practices Affecting the Health of Women and Children (GAMCOTRAP) and Amie Bojang-Sissoho, programme co-ordinator were yesterday arraigned at the Banjul Magistrates' Court charged with theft.

The charge alleged that Dr. Isatou Touray and Amie Bojang-Sissoho sometime in the year 2009, in Banjul and diverse places in The Gambia, jointly stole the sum of 30,000 Euros being money provided by the YALOCAMBA SOLIDARIDAD of Spain to GAMCOTRAP. Both denied the charge.

In applying for bail, Lawyer Mboge who led a team of defence counsel, told the court that the section under which the accused persons were charged means this is a bailable offence.

"The 1st accused person has a registered NGO since 1984, and they all have families and children in this country and, if granted bail, they would not abscond. They will be available any time the court needs them," said counsel Mboge.

The defence counsel pointed out that the sum allegedly involved would not worth his clients absconding. He added that, if the court grants them bail, they would have people who are willing and able to stand for them as sureties, if the bail conditions are not excessive.

"Remanding the accused persons in custody would be a serious constraint to them in their defence, as they need more time to consult with their counsel for the preparation of their defence", he said, before urging the court to grant the accused persons bail.

Responding to the defence counsel's application for bail, police prosecutor chief superintendent Tijan Badjie told the court that the prosecution was objecting to bail for the accused persons.

He added that the prosecution brought the case to court just for mention, as the investigation was not yet complete.

Prosecutor Badjie further stated that the law of this country did not allow for accused persons to be kept for more than 72 hours without taking them to court for formal charge.

He said the accused persons were under police bail, but the investigators fear that they are influential at the GAMCOMTRAP and in the country.

Badjie went on to state that what is before the court is a just a holding charge, and that the case would proceed whenever the investigation was completed.

Principal Magistrate Emmanuel Nkea subsequently ordered that the accused persons be kept in police custody until today, for ruling on the bail application.

Other defence counsel are Sagarr Jahateh and Ebrima Jah.

Speaking to reporters after his audience with the Gambian leader the project coordinator for Africa, Daniel Giddings, on behalf of the team, said they were at State House to express their desire and plan to work on special projects in The Gambia. He said their main focus is developing the tourism industry and the education sector and also working on projects on projects on micro credit in the province, targeting mainly the youth and women.

Mr Giddings added that their NGO is working closely with the Spanish government and have been supporting countries particularly in Latin America in those areas and noted that The Gambia is the first country in Africa to benefit from the project.

Dr. Touray, Amie Bojang Sissoho Remanded

Two female human rights defenders, Dr Isatou Touray and Amie Bojang Sissoho of The Gambia Committee on Traditional Harmful Practices (GAMCOTRAP), who were arraigned before the Banjul Magistrates’ Court on Monday 11 October and re-arraigned on Tuesday 12 October, were denied bail by the Court and were subsequently sent to the female remand wing of the Mile 2 Central Prison till 20 October, when their case would resume.

When the case was called in a crowded court room, Chief Superintendent Tijan Badjie announced his appearance for the Inspector General of Police (IGP) while Lawyers Amie Bensouda, Sagarr Jahateh and Ebrima Jah announced their appearance for the two female activists.
Delivering his ruling on whether or not to grant bail to the two accused persons, Magistrate Nkea said the Court needs to consider a number of factors on whether to grant bail to the accused persons or not. He stated that the defence has forwarded some facts about the granting of bail, but has failed to indicate whether the accused persons will not interfere with the case when granted bail.
Magistrate Nkea posited that the prosecutor advanced that the accused persons are very influential people within the society and could therefore interfere with the investigation of the case when granted bail. He added that the prosecutor asked for the Court to remand the accused persons for two weeks pending the outcome of the investigation into the case.
Magistrate Nkea ruled that he found it very difficult to make a decision on the arguments forwarded by both sides; because they both addressed him orally. He stated that he is compelled to order the police to expedite their investigation into the matter. He also ordered that both accused persons be remanded for a week at the Female Wing at the Mile 2 prison and to appear before the Court on Wednesday 20 October.
Doctor Isatou Touray, the Executive Director of GAMCOTRAP and Madam Amie Bojang Sissoho, the programme officer of the Organization were arrested on Monday 11 October and charged with theft. They were arraigned before the Court on the same day and both of them pleaded not guilty to the charge against them. They were detained at the Banjul police station over night, pending the ruling on the argument about granting them bail or not.
Doctor Touray and Madam Bojang Sissoho are charge with “Theft”, “The charge sheet read as thus, “the duo in 2009 jointly stole the sum of 30, 000 Euros provided by the “Yolacamba Solidaridad” in Spain to GAMCOTRAP in The Gambia and thereby committed an offence.’’

State Accused of Improper Investigations into GAMCOTRAP Case

Lawyer Amie Bensouda Monday accused the state of conducting improper investigations into the theft allegations against the two top officials of Gamcotrap, a women’s rights NGO.

Amie Bensouda, who is leading the team of defense counsels, came to this conclusion after grilling the state witness, a state investigator during cross-examination at Banjul Magistrates’ Court presided over by Nkea.
GAMCOTRAP’s executive director Dr. Isatou Touray and programme coordinator, Amie Bojang-Sissoho are accused of stealing 30,000 Euros being provided to them by YALOCAMBA SOLIDARIDAD, a Spanish-based NGO, but both pleaded not guilty.

When Bensouda put it to the state investigator that Gamcotrap is not a central bank licensed micro-credit organisation, thus not legally permitted to give-out micro-credit, as alleged by the state, the state witness said he did not know that a central bank license is required for one to operate a micro-credit.
Madam Bensouda also put it to him that Gamcotrap received three transfers; first, on the March 16, 2007 with the sum of 41,958 Euros, the second April 9, 2009 with the same amount and on September 11, 2009, a sum of 45, 794.90 was transferred.

The witness however said he could not remember how many transfers YOLOCAMBA made to Gamcotrap adding that he did not check the money that Gamcotrap received as it was not part of his term of reference.
“I was only assigned to investigate the 30, 000 Euros that was sent to Gamcotrap by YOLCAMBA,” he revealed.

The trial continues January 3.

The CRIMINAL that deserves caging up is Yaya Jammeh. This fellow stole a whole republic and held good citizens hostage for nearly 20 years now. Yaya Jammeh is ready criminal.

Mr Jammeh, without your deadly weapons, people will stand your crooked face and tell you off. What do you think of your improper self?

NIA OFFICER CONTINUES TESTIMONY IN GAMCOTRAP CASE

Lamin Manneh, the seven prosecution witness and an NIA officer attached to the Office of the President on Tuesday 4th of January continued his testimony before Principal Magistrate Emmanuel Nkea of Banjul Magistrates’ court.

Under cross examination Mboge asked the witness to make a look at exhibit E i.e. the Police report and asked him whether Omar Dibba’s statement reflected anywhere in the report; Manneh responded in the negative and added that all documents received came as annex and he was not the recipient. Manneh said that Daniel was before the panel and he was contacted through telephone and he appeared before the panel.
In exhibit E you over sigted Omar Dibba’s statement? Asked Mboge. I cannot remember Dibba making a statement, Manneh responded.
An email Correspondent (exhibit A1) was shown to the witness by the defence and witness said it is correct that he relies on exhibit A1 during investigations. He further testified that it is for the Panel of investigation to decide whether a statement should be obtained from Dibba or not. “Does that not show that your report was bias”? Asked Mboge. In response, Manneh said he believes that what he was told was correct.
At this juncture the defence shows the witness exhibit E, page 5, evidence of Tombong Jatta, the second prosecution witness in this case. Manneh told the court that he knew that Jatta gave evidence in this case and she told him that she was not given her fare as well as the fares of ten extra Youths.
When he was asked by the defence whether he knows the case of Lamin Karbou and others before the High Court, he responded in the affirmative, adding that he is also aware about the NIA torture case before the Banjul Magistrates court but denied being aware of the assault of Lamin Karbou by his officers.
Mboge said: “I am putting it to you that you are notorious of misleading courts”. The witness said all what he said in court is the truth. Mboge Further put it to him that all what he is saying is not true because he is acting on information. Manneh acknowledged that YELOCOMBA has paid one thousand Euros for the second Phase of the project but said he did not know that the second phase of the project was ten million dalasis, adding that he did not know how much the project is as far as he is concerned and that he did not find out. “You did not bother to find out because it is favourable to the accused persons”, Said Mboge “That is not correct, Manneh replied. He testified that he knew that the 2nd accused (Amie Bojang Sissoho) was on her way to Spain to raise funds for the second project, adding that he did not know whether five million was approved and paid for the second project.
Mboge further asked him whether he has seen the document for the second project but the witness said he knows that one thousand euro was paid because one Musa Jallow investigated and therefore it should be in the report of the Panel investigators. He added that the payment of the one thousand euro for the second phase of the project is not in the report but it is in the statement and he denied being bias or over sigted.
Do you know what a liar is? Asked Mboge. Manneh replied in the positive. What is a liar? Mboge asked? Someone who doesn’t speak the truth, said Manneh. And that is you said Mboge. “Why did they approve ten million and not fifty five thousand while they have stolen thirty thousand euro?” asked Mboge. It was reported to me, said Manneh.
“Your entire evidence is inaccurate and full of stories” said Mboge. All what I said is true asserted Manneh.

The president of the Republic has rescinded the appointment of Ebrima JT Kujabi who was appointed as Ambassador-at-large based in the United States of America with immediate effect, a media dispatch from the presidency revealed.

The release stated: The General public is hereby informed that Mr. Ebrima JT Kujabi who was appointed as Ambassador-at-large based in the United States of America with effect from 26th April 2010, has his appointment rescinded by His Excellency, Sheikh Professor Alhaji Dr Yahya AJJ Jammeh, president of the Republic of The Gambia with immediate effect.
