I think it has become ever more prevalent to have a State Ethics Code of conduct in The Gambia as the governing body in determining gifts and special privileges for government employees and their Families by would be prospectors. The fact is Gambia should have a disclosure law to ascertain that government officials are not being corrupted, annually all Government employees especially CEO's and Managers in general should be subjected to disclose all gifts received from each single source.
I know it may seem impossible but it's worst when top government officials, as in the last inquiry stated that some of them were given Mercedes ML320 by prospectors or business entities or so called friends. Why should we need an ethics code or a disclosure act some may ask? but the reasons are many and Gambia being a developing nation with prospectors from all walks of life, The fact of the matter is these so called prospectors bearing expensive gifts have interests that may be affected by discretionary actions in terms of the government employees, whether it applies to their actions in determining the outcome of the projects or not.
The Gambia government should enacts laws and acts preventing any State or Government employee from receive gifts from any prospector above a certain determined amount and this should also included their spouses and family members. It is a norm in the Gambia that out of every contract there is a kick back of atleast 5-10 percent for parties involved and Gambia being a developing state , it has led to unscrupulous business men utilizing the weakness and poverty in the region to score contracts which otherwise would have not been granted given their lack of expertise or experience in the field. Greasing the right hands can get you to fly a motor cycle in the Gambian Skies if all the right hands and elbows are properly greased.
This applies to all the industries thatI know of. It may be hard to implement and that is just a maybe, but without a discretionary code of conduct Gambia Government employees can always be manipulated and bribed the legal way to ensure that the outcome always benefits the prospectors and it would be considered legal bribery. The state ethics code should have a number of statues that should prohibit the acceptance of certain gifts such a monetary, vehicles, houses and other illegal perks that Gambians seem to be enjoying. The state ethics code should be liberally construed to promote high standards of ethical conduct in the State Government and as long as it can be inferred that a a gift is intended to reward or influence the decision making ability of any individual, should be considered illegal.
No Gambian should solicit or accept any kind of compensation or consideration for the performance of their duties. Easier said than done I have been told but the fact still remains as a nation there is no oversight institution to ensure that the trusted state officials are not corrupted in the process of doing their jobs. Should there be a State Ethics commission to determine whether gifts being received by Employees are legal or Illegal? well that is a must and it all depends whether Employees will even report such malicious practices. Discipling the Gambia workforce is not only a necessity but there is a need for it. Without an Ethics commission in place any tom dick and harry with a vested interest can bribe their way in the Gambia to ensure their interests are held at high regards.
In America the American president is not allowed to take certain gifts worth more than 20-200 dollars if am right and anything worth more than that belongs to the US treasury department. This applies to all federal and state employees as in the case of the Gambia this would include the Gambia's notorious police force and law enforcement agencies. Establishing a state ethics code could just curb the practice or limit the influences of bribery in our society.
Gifts from other countries and nations worth more than 200 Dalasis if you ask me should be reported as property of the State and highlighted as being received by the treasury department. This does not only apply to government employees but will stop leaders from soliciting aid and sponsorships from unscrupulous entities with a vested interest in our economy................................................Peace
