I wonder if Badou Conteh has read Bantaba in cyberspace topic:

If he has surley he could use an argument to have the case dismissed,what do you think ? the circumstances are very similar.In my opinion it appears to be another mistake prosecuting this case,or maybe not ?

(Just like KAY says I am not an attorney !!! )

The defence counsel for Neeraj Sharmp, manager of Safe-way Supermarket - who is facing charges of cheating, on Monday, objected to a withdrawal application filed by the police prosecutor, ASP Bojang, who told the court that he wanted to withdraw the case under section 68 sub-section 1 of the Criminal Procedure Code.

He stated that the prosecution has the mandate at any stage of the proceedings to withdraw their case even before the announcement of the judgement. In response to this, the defence counsel for the accused, Badou Conteh, informed the court that he had filed a no case submission to which the prosecution had to reply and said that the accused should be acquitted and discharged.

Neeraj Sharmp was said to have on 19th October 2009, at Safeway Supermarket, by means of a fraudulent trick obtained from one Rohey Cham the sum of D210 for a kilo of meat, a greater sum than that fixed by the municipal authority.
