My favorite Judge may have rocked the boat too much by his latest words to a States Counsel lawyer who he has banned,however I agree with what he has done,the Courts must have respect and those appearing before judges must respect that office.Will Judge Moses Richards remain in post after the return of H.E. from America ? I hope so,have a read and see what you think, this from The Daily News,a newcomer on the scene of newspapers reporting news from Gambia.

Judge Expels State Counsel
In Babylon Criminal Trial

Justice Moses Richards of the Special Criminal Court of the High Court in Banjul yesterday asked Mrs. Nebu B. Jones the state counsel in the trial, to vacate his court and never to appear before him again.

Presiding over the criminal trial of the 28 accused persons allegedly involved in the Babylon arson case, Justice Richards made this order to the effect due to what he term as the arrogance behavior of the state counsel. “We have a duty to protect the integrity of the Bench. Because of her arrogance that is why she is kicked out from my court”, said Justice Richards.

The whole drama started when Nebu B.Jones, the state counsel told the court that the state has filed a motion at the Gambia Court of Appeal in connection to the case. The counsel for the accused persons Antouman Gaye said he has preliminary objection to this on the grounds the application is misleading and hopeless. Special Court

is. “Infact, for two months I did not sit when this court was set up … for the fact that I wanted to have something in paper that will see how to govern this court among other things”, he said. Even though she was asked by the presiding Judge to sit down, Mrs. Jones could be seen standing. This move seems not to go down well with the presiding judge, prompting him to order her to leave the court and not to appear before him again.

State counsel Bakum later stepped in her shoes while Antouman Gaye, counsel for the accused persons continued with his preliminary objection. All the 28 accused persons were in court.The trial continues today Thursday 24th September, 2009 for the respondent to reply to the defense counsel’s preliminary objection.

As you know I have followed this mans career,and have seen his integrity before, however,he MAY have gone too far this time,we will have to follow future events.

Moe, now that the fencing match between you and Snuggles has taken a break so you both can rest a while from this exhausting excercise, I will answer the question that apparantly caused your skirmish,

A person appointed as STATE COUNCIL must have more knowlege and respect for the Office of Judge and a Special Criminal Court than Mrs Nebu B Jones showed in her outburst.

Justice Moses Richards of the Special Criminal Court of Justice in Banjul, last Friday, commended the Inspector General of Police, state prosecutors from the AG’s Chambers and the private legal practitioners who worked during the summer vacation at the special criminal court.


Justice Richards disclosed that during the court sessions, the court heard several matters, most of which are now adjourned for judgment. Justice Richards hailed the private legal practitioners who made time to represent their clients during the vacation as some normally travel out of the country. Justice Richards commended the Inspector General of Police and the Prison authorities for their relentless contribution in ensuring that suspects were arraigned before the special court. He noted that the special criminal court was a court of summary jurisdiction, which operates with great flexibility.


Justice Richards said most capital offenses like murder, manslaughter, and rape, among others, which had in the past been completed in two to four years can now be completed in two to three months. He thanked all who made the summer vacation court sessions a success, including the court clerk, Sarata Janneh-Touray, and the interpreter Dodou Manneh - a polyglot and a sign language expert.

There is still a problem with lawyers,or rather the money for them to be paid, it appears that the State has insufficient funds to pay for a defence lawyer and that the defendants have insufficient funds to pay for their own,The Judge obviously does not want the defendants to be at a disadvantage on such a serious matter so is trying his hardest,will anybody pay the lawyers or will this matter stay on the books and the defendants reside at Mile 2 for a long time?

Alleged 16 Terrorists’Trial Still Drags

The trial of the 16 alleged terrorists charged with alleged terrorism was on Thursday 24 September, 2009 adjourned to 12 October by Justice Moses Richards of the Special Criminal Court in Banjul.

This development came against the hope that on the next adjournment date, the State would have provided lawyers for them or their relatives would have looked for lawyers for each of them. Only one of the accused persons Kebba Seckan has a lawyer.

When the matter was called before a crowded court room amid high security presence, the principal state counsel S. H. Barkum told the court that the issues of legal representation for the accused persons is still not possible.

The presiding judge then suggested to the accused persons to talk to their relatives when they come to visit at prisons, to look for lawyers who will defend them in court rather than coming to the court every time without any legal representation.

“The state can give you lawyers but it takes time. So your relatives need to endeavor and get lawyers for each of you”, he told them. He further ordered that the Master and Registrar of the High Court make arrangements to get legal representation for the accused persons in order for the trial to proceed accordingly.

The 16 accused persons are charged with several counts of criminal felony, including terrorism, contrary to the Anti-Terrorism Act of 2002, Laws of The Gambia. According to the particulars of offense, the accused persons on or about the 8th August 2006 at Darsilameh village in the Western Region and diverse places, jointly conducted or engaged themselves in an unlawful act, which may have seriously destabilized the fundamental, political, constitutional, economic and social structure of The Gambia.

In a related but separate trial, the 28 accused persons in the Babylon Arson Case is adjourned to the 14 October for continuation.

The criminal trial of one Mariama Sarr resumed on Monday before Justice Moses Richards of the Special Criminal Court in Banjul, when the state was ordered to file its address before the said court on October 12, 2009.

The accused is alleged to have murdered her adopted child on September 29, 2008, at Juffureh Village in the North Bank Region of The Gambia. The state and the defence had closed their case and the counsel for the accused person, Lawyer A Martins has informed the court that he had filed in his written address.
