Gambia: Kerewan Double Murder Case Commences Fabakary B. Ceesay 8 June 2009
The double murder incident that struck Baddibu Kerewan on 2 March, 2009, involving a Malian national, was on Thursday 4 June heard by Justice Moses Richards of the Banjul High court. The accused person Amadou Jarra was present in court but his defence counsel Mrs. Sagarr Jahateh was not present. The court proceeded with the case without the presence of the defence counsel.
The first prosecution witness, Ansuma Fatajo told the court that he is a native of Kerewan and an employee of Africell GSM Company. Fatajo said he knew the accused person, who was brought by his elder brother to live with them in their compound. Fatajo said on the day of the incident at around 10:00pm, he was in his room when he heard a scream outside. He indicated that when he came out he saw two women stabbed and seriously bleeding lying on the ground. He said the two women were Nyimasata and Kinti. He added that they were lying in a pool of blood. He asserted that the intestine of Kinti could be seen protruding outwards. He said with the help of people, they carried the two wounded women to the Kerewan Police Station and the police took them to hospital. He added that he later left for his home. He told the court that he had no relationship with the accused.
The second prosecution witness (PW2), Mustapha Jawara told the court he is a carpenter by profession and a native of Kerewan. He said he did not know the accused. Jawara said on that night, he heard people screaming and when he enquired he was told that a "Bambara" had stabbed two women to death. He said as he was involved at the scene the police were about to arrest him. Jawara added that he saw the accused person throwing the knife away as the police were approaching him to execute arrest. He indicated that the knife was stained with blood. He said when he picked the knife he handed it over to the police and then went home. He was shown a knife and he identified it as the knife he gave to the police. The knife was tendered in court for identification purposes. It was admitted and marked as prosecution ID1.
The third prosecution witness, Sulayman Sonko, a policeman attached to Kerewan police station, said he was on duty that night when he heard a crowd saying "He has a knife". He said he then asked his colleague Bakar Kassama for them to go out and find out what was happening. Officer Sonko indicated that almost 200 metres from the station, they saw the accused person running towards the station with a knife in his hand and a crowd pursuing him. He asserted that before he got there he fell down and the knife fell off his hand. "We arrested him and prevented the mob from beating him. The crowd was saying that he killed two people. They were armed with cutlasses and sticks and were saying we will kill him," said Sonko.
Officer Sonko pointed out that Mustapha Jawara later brought the said knife to the station stained with blood. He said the knife was labelled by him. He added that both victims, Mrs. Nyimasata Ceesay and Kinti Fatty were brought to the station on board a donkey cart seriously bleeding. He added that they were alive at that time. Sonko indicated that Kinti was stabbed at the belly and her intestine could be seen coming out from the wound. He added that her belly was wide open. Sonko said Nyimasata was stabbed at her back side and was bleeding continuously. Sonko added that both the victims were taken to Kerewan health centre where they were given first aid treatment and later transferred to Farafenni hospital. He added that a case file was later opened and the accused person was cautioned and a statement was obtained from him.
Officer Sonko further stated that on the 3rd March, they got news that Nyimasata Ceesay had died, which he said prompted them to escort the accused person out of Kerewan to Banjul for fear that the villagers might attack the station to revenge against him. He added that later on the same day they got news that the second victim Kinti Fatty also died. He indicated that both the deceased were taken to RVTH for postmortem. Officer Sonko indicated that when they confronted the accused person on the matter, he confessed to them that he stabbed two women who were his hosts. He added that both deceased are of the same husband. He said it was the husband who brought the accused person to stay in their compound as their stranger. He concluded that he later compiled every thing pertaining to the case and submitted it to the serious crime unit of the police at the police headquarters in Banjul.
Before the matter was adjourned, Justice Richard told the accused person that his lawyer would be given the opportunity to cross examine the witnesses by the next date of adjournment. Case adjourned till 17 July.

No one comments on bantaba in cyberspage bothers to comment on the doings of this Judge,well I will,I wonder why the defendants were granted bail in the first place? the learned Judge made the following comments; "Justice Richards disclosed that there were some procedural irregularities in the way the accused persons were granted bail."
I wonder what they were ?
