TREND TOWARDS AUTOCRACY AND DICTATORSHIP CHALLENGED IN COURT; .....A Good Test for Gambian Judiciary
The opposition political parties, namely; the UDP and NRP, have finally decided to resort to court to challenge the recent amendments of the constitution and the Local Government Act.
The suit which seeks a declaration that the amendment of the constitution entitled, Gambia Constitution 1997 Amendment Act passed by the National Assembly and assented to by the president on September 2007, runs contrary to the spirit and intendment of section 193( 1 of the constitution and therefore void and of no effect.
The two parties also seek a declaration that the bill entitled Local Government Act 2007 also passed by the National Assembly, on 31st October and assented to by the president on November 19th, was made in excess of the powers conferred on the National Assembly and the president; that the Local Government, 2007 Act No. 13 of 2007 is null and void, and of no effect.
The plaintiffs UDP and NRP and the minority leader of the National Assembly are seeking an injunction restraining the IEC, Independent Electoral Commission, the second defendant, from holding or conducting elections for the Municipal and Local Government Authorities scheduled for January 24th, 2008.
Mr. Ousainou Darboe represents the plaintiffs, Amie Joof Conteh represents the second defendant, the IEC, and the Secretary of State for Justice was present as the first defendant.
These undemocratic amendments made by the National Assembly has put the opposition parties in a dilemma knowing fully well that after spending thousands of Dalasis to win a seat in the councils, the president can dismiss the winners as and when he wished.
The UDP has already announced that they would file candidates to contest the elections. The NRP and the NADD has not made any public announcements on the January elections so far. Some see UDP's filing candidates as a contradiction; that they should decide one of two things, either to boycott and challenge in court or to contest but not to do both. The UDP and NRP's action is however applauded by many as a good step to challenge the Jammeh administration?s move towards autocracy and dictatorship.
