FATOU JAW MANNEH STILL WAITING


Since she set foot in her homeland on the 28th March Fatou Jaw Manneh has become a hostage. She came home to pay respect to her deceased father who passed away in her absence. Her mother is also in her sick bed.

The trial started in earnest on 12 April and witnesses were examined, cross examined and re-examined.

However, before the prosecution finished its case new charges were filed requiring the recalling of witnesses and the introduction of new witnesses.

These witnesses were examined, cross examined and re- examined.
Before the prosecution finished its case the Magistrate relied on law to transfer the case from Kanifing to Banjul.

Since then everything is quiet. She cannot leave the country and has not prepared herself to stay. She is in a limbo.

What practical lesson is she being taught about Gambian Democracy? Who is qualified to tell the courts to speed up her trial? At least the president should be concerned with the country’s human rights record.

The only person we can call upon to intervene is the Chief Justice.

According to section 121 subsection 1 of the Constitution “The Chief Justice shall be the head of the judiciary and subject to the provision of this constitution shall be responsible for the administration and supervision of the courts”.

Fatou is, therefore, in the hands of Gambian Justice. Will Justice be done? Will Justice be seen to be done? Time will tell!! History will be the judge.
