FORMER BAC FINANCIAL CONTROLLER’S CASE CONTINUES

The trial involving Mr. Fafa Kuyateh, the former Financial Controller at the Brikama Area Council resumed on Monday13th November 2006 presided over by Magistrate E.F M’bai of the Brikama Magistrate Court.

The accused Fafa Kuyateh is charged for obtaining an amount of D230, 000 (two hundred and thirty thousand dalasis) from one Bubacarr Cham by false pretence over a piece of land that is situated at Nema Kunku village.

Making an application for the accused to be acquitted and discharged, the defence counsel, lawyer Jobarteh said, the representations by the accused by words or otherwise are in no way false in that the subject of the charge (that is the land) is in existence. Counsel Jobarteh further said that no effort has been made by the Police to ascertain how the accused acquired the said land. He lamented that it is not in dispute that the said land was acquired by the accused from one Abdourahman. Counsel Jobarteh stated, that document verifying the legal transfer of the said land to the accused, which was endorsed and signed by the Chairman of the Brikama Area Council has been ignored by the Prosecution. Counsel Jobarteh further stated that no efforts were also made by the Police whatsoever to find out who was actually developing the said land.
According to the defence council, no efforts were made by the Police to contact the Alkalo of Nema Kunku where the land is situated; and said it was clear that the Alkalo of Nema Kunku has informed the land developer that the said land belongs to the accused. Counsel Jobarteh also pointed out the ineligibility of the Yundum Police to prosecute the case, and said the said land at Nema Kunku falls under the Wellingara Police Jurisdiction. Counsel Jobarteh however argued that the Prosecutions evidence is indeed weak and insufficient.

Counsel Jobarteh finally urged the court under the said circumstance to acquit and discharge the accused accordingly. At this Juncture, the prosecution applied for an adjournment, which was granted by the presiding magistrate. The case was adjourned to 27th November 2006.
