“The leader of the main opposition United Democratic Party (UDP) Lawyer Ousainou Darboe told the Daily News that with a free and fair elections the APRC has no place in the Gambia’s politics”. Darboe was speaking in an exclusive interview with the paper.
It is quite obvious to everyone that, the APRC government under the leadership of President Jammeh has no respect for the rule of law. Darboe said it is clearly manifested that the APRC government is not attending to the problems and concern of Gambians. People are hungry and poorer today than they were in (1994). One could see that services are degenerating, some of our health post being close due to lack of drugs and personnel. All this shows that this government lacks the capability to deal with the problems of the Gambians.
“I always have the interest in coming together with all other political parties to eliminate the APRC regime. The coalition of six worked so hard recently to have a valid electoral reform, electoral reform that is not cosmetic but a real. Protection of right to personal liberty has been abused or violated by the Jammeh administration. Detention without trial and arbitrary arrest were the order of the day. The affected people were not only arrested but keep them beyond 72 hours constitutional requirement.
All these uncalled for actions of the regime demonstrates the fact that this government under President Jammeh has no regard for peoples. There were instances where people have been detained for more than 30 days, and were made to appear in the court and later discharge. In some of such cases they are humiliated. Once such is done to them, their images already are tarnished. We have seen horrible allegation levied against such people and they were subjected to harsh trials only for them to be released them. Such people will continue to live in humiliation because members of the public have already form opinion about them.
Darboe said the above shows that this country needs a government that respects the rights of its citizens. “Am not advocating that criminals should be treated with royal privilege but every individual human being must have right of liberty. Should there be such detained person and prisoners should have their rights respected.
“You cannot just trample on the right and freedom of people because you are in the office. Violation of the rights of such individuals should be a lesson for all those who are themselves facing the same violation today as they stand trials” Darboe said
The politician was not the least happy with the state broadcaster which is the National radio and television services GRTS. He claims that the GRTS only carries only the views of the APRC government more than any other party during and after elections. They pretend to carry out divergent views during the election periods but after elections divergent view are not carry out .It is the APRC view which is carry out through years to another election year.
Darboe give credit to the local newspapers who he said gives equal space to all parties including the ruling APRC party. He asked why the national broadcaster is not doing the same after all journalists everywhere go to look for news.
The opposition leader opined that Those working for the national broadcaster should go out where divergent view are been express and have it relate over the GRTS. Why can’t they do it when they has the backing of the 1997 constitution, section (208) did allow them to respect divergent views.
He said it is a shame for the present regime to deter the media from airing divergent views. They are on record of accusing the former regime of monopolizing radio Gambia.
The Veteran opposition and lawyer said yes there was no IEC in the first republic but there was provision in our books of laws for the local government to take lead in elections. If you look at the republican constitution the supervisor of the election is independent of any authority he act on his own judgment is not subject to the directive of anybody.
That individual is better than the IEC today, there is a petition I handed over to the IEC where we are able to expose double registrations but you cannot have a registration officer of the IEC in court to speak the truth, all fear of the powers that be, for if they do immediately you left you will disappear. In those days the supervisor do come to court and speak the truth.
Now you cannot have the chairman of IEC to court and speak the truth so where is independence? Is not the institution called Independent Electoral Commission. It is the system and the environment that allow a free operation for an institution to become independent.
In those days there was no Ombudsman but the public service commission do not dismiss anybody without due process and there was no interference.
