Washington Letter Writer Faults Lamin J Darbo's Legal Opinion On Bah's Candidature

I was flabbergasted after reading one Lamin J Darbo’s (a UK- based lawyer) article arguing without any legal basis that, Hamat Bah was not qualified to run as an independent candidate in the forth coming presidential elections in The Gambia. Mr Darbo, who claimed to be a former magistrate and now a lawyer (allegedly) in the UK, appears to be unable to read and understand the very section 61 of the Constitution he cited. Section 49 has no relevance since it merely states, only candidates sponsored by political parties and independent candidates can file complaints to the Supreme Court with regard to elections fraud. Section 61 is basically saying in probably the simplest terms, institutions like e.g. Action Aid, Gamcotrap etc, cannot sponsor candidates for president, period. There is nowhere in that section that says no person can run as an independent candidate for the post of president.
Mr Lamin J Darbo’s article could be seen as someone who is aggrieved that Hamat Bah did not support UDP since there are no legal bases on his argument. One does not have to be a constitutional lawyer to understand that his argument is baseless, and probably malicious. There are those who argued that he (Lamin J Darbo) may be right but that the Independent Electoral Commission— IEC, accepted Hamat Bah’s nomination because they preferred a divided opposition. There is not an iota of truth in that argument; it’s simply that there is no provision in the Constitution or election decree that prohibits any one contesting the presidential election as an independent ….PERIOD!
