Adjourned to 31st January,the usual problem no one is capable of personal responsibility and making a decision.

In Moses Richards case State needs more time to decide Africa » Gambia Tuesday, January 18, 2011 Principal Magistrate Emmanuel Nkea of the Banjul Magistrates Court yesterday adjourned the case of Moses B Johnson Richards, following the application made by the state on the grounds that the Attorney General (AG) was yet to give directives on the letter written to his office by the Gambia Bar Association.
When the case was called, Simon A. Abi appeared for the state and Surahata Janneh and other members of the Bar Association appeared for the accused. Simon A. Abi applied for an adjournment on the grounds that the AG was yet to give directives on the letter he received and he did not have any of his witnesses in the court. The defence, led by Surahata Janneh, objected to the said application, stating that there is nothing wrong with the AG taking a decision but that it is unfair to the bar, to be coming to court only for the case to be adjourned. He therefore urged the court to reject the application.
State counsel Abi in his reply disclosed that it is the defence that made the case to take this direction because they wrote to the AG. He added that he sees no reason why the same defence should object the application again. The court in its ruling, urged the prosecution to be proactive on the matter and added that the prosecution needs time to put its house in order.
