14 villagers charged with arson & felony remanded at Janjangbureh prison

Magistrate Sainey Ndure of the Bansang Magistrate Court in the Central River Region (CRR) has remanded 14 villagers of Kerr Mot Ali in the Upper Saloum District, Central River Region (CRR) at the Janjangbureh Prison pending their appearance at the High Court.

The accused persons are facing two counts of felony and arson. However, they both pleaded not guilty to the charges.

The accused persons; Omar John, Ali Ceesay, Abdou Mbaye, Ali Secka, Ali Ceesay, Musa Mbaye, Haddim Ceesay, Mod Talla Secka, Modou Habib Secka, Abdoulie Sowe, Batch Samba, Modou Habib Secka, Sheikh Sey and Mustapha Ceesay are all facing conspiracy to commit felony contrary to section 32 (a) of the criminal code cap 10 Volume 3 Laws of The Gambia and Arson contrary to Section 305 of the Criminal Code Sub Section 8 Cap 10 Volume 3 Laws of The Gambia.

According to the particulars of offense, all accused persons sometime in the month of May 2022 at Kerr Mot Ali village in The Gambia in the Upper Saloum District of CRR, conspired among themselves to commit felony there with arson thereby committing an offense.

Count two states that sometimes in the month of May 2022 at Kerr Mot Ali village, all the accused persons wilfully and unlawfully set fire and burned the houses of Musa Secka, Lamin Sowe and Alhagie Ousman Secka to ashes.

Shortly after their plea of not guilty, police prosecutor Sub-Inspector M. Conteh assisted by sergeant 3449 Kemo Jabang applied for the case to be transferred to the High Court and that the accused person to be remanded in custody, arguing that the magistrate court lacks the jurisdiction to entertain the case in accordance with the special criminal code.

However, Lawyer Sheriff Kumba Jobe, who announced his appearance for the accused persons argued that since the court that the Bansang Magistrate Court lacks the territorial jurisdiction to entertain the matter, arranging the accused at the said magistrate court is violation of the accused rights and that the prosecution team didn’t follow due process.

Lawyer Jobe further urged the court to discharge the accused persons, citing competence, territorial jurisdiction and merits.

However, after thorough look into the two submissions made by the two parties, Magistrate Ndure overruled the defence’s application, thus ordering for all the accused person to be remanded in prison pending the ongoing investigation.

It Must be remembered that this man has been charged but not appeared before a court so is innocent until proven guilty and sentenced by a court.

A Senegalese national is in police custody in connection with last month’s assault on the restless border village of Kerr Mot Ali.

In May, the village became the scene of violence after an alleged arson on two houses sparked tension between the Gambian and Senegalese sides of the village, reopening a deep-seated animosity between the peoples. Security personnel were deployed to restore calm and order in the village. The Gambian side later accused their siblings in the Senegalese end of setting the houses on fire.

One of the suspected attackers, police said, is a 56-year-old Senegalese, one Sagar Ceesay Secka, arrested yesterday in the Gambian village.

“He was said to be part of a group of disciples of one Serigne Basirou Seck in Kerr Mot Ali Senegal, who attacked Kerr Mot Ali Gambia and set some houses ablaze,” police deputy spokesman, Inspector Alieu Jamanka confirmed the arrest.

He said Mr Sagar has been at large since the violent assault last month, but a secret warning to police ensured his arrest last Sunday.

“He was apprehended on Gambian soil. The man has a farm in The Gambia, and so he crossed the border to come and clear his farm for the rainy season. That was when we got a tip-off and our officers sprang into action and got him,” the deputy police spokesperson said.

Sagar is charged with arson and conspiracy to commit felony. If convicted for arson alone, under Gambian laws, he would face life imprisonment.

Fourteen people were jointly arrainged at Bansang Magistrate Court before Magistrate Sainey Ndure and charged with Two Counts which include Arson, in Kerr Mot Ali Gambia in the Upper Saloum District of the CRR.

The accused persons are Omar John, Ali Ceesay (A), Abdou Mbye, Ali Secka, Ali Ceesay (B), Musa Mbye, Haddim Ceesay, Mod Talla Secka, Modou Habib Secka, Abdoulie Sowe, Batch Samba, Modou Habib Secka, Sheikh Sey and Mustapha Ceesay.

On Count One, all accused persons were charged for conspiracy to commit felony, contrary to Section 32 (a) of the Criminal Procedure Code Cap. 10., Volume 3, Laws of The Gambia.

According to the particulars of offence on this Count, all the accused persons sometime in the month of May 2022 in Kerr Mot Ali village in the Republic of the Gambia, in the Upper Saloum District of the Central River Region, conspired among themselves to commit felony by arson and thereby committed an offence.

On Count Two, the accused persons were jointly charged with arson contrary to Section 305 of the Criminal Procedure Code, sub-section 8 Cap. 10. Volume 3, Laws of the Gambia.

According to the particulars of this second offence, all the accused persons sometime in the month of May 2022 in Kerr Mot Hali village in the Republic of the Gambia in the Upper Saloum District of the Central River Region, willfully set fire and burned down the houses of Musa Secka, Lamin Sowe and Alagie Ousman Secka to ashes, thereby committed an offence.

All accused persons pleaded not guilty to both Counts.

At this juncture, the Prosecution demanded that the case be transferred to the Banjul High Court because arson is capital offence that cannot be determined by a Lower Court.

The accused persons were further remanded awaiting continuation of trial.
