Re: China condemns assault on Sanyang fishmeal factory

April 7, 2021 by Fatou Jaw manneh

I am appalled at the adverse misdirected plea from the Chinese Ambassador after the Sanyang incident. Chinese fishmeal factories are exploitative to the Gambia and the local communities within which they operate. Still, their operations are outright ruthless and criminal in The Gambia and throughout the African continent. Interesting to note that the Chinese Ambassador is more concerned about protecting the fishmeal business than the destruction and havoc their operations are causing the Gambian communities. It is destructive to our economy, the environment, and our food security. I am disappointed that the Ambassador is more concerned with profits than saving the Gambian people’s lives. His plea to the Gambian government is unfortunately misrepresented and misplaced. I am still baffled at why the Gambian government has not shut down all these fishmeal factories in the country, considering the very negative and disastrous consequences on our communities since 2016.

If the Gambian government did not close these Chinese fishmeal companies in the country, the frustrated youth and the community will choose to protect their rights and livelihood. Dialogue is most welcome, but these fishmeal operations are nothing but causing havoc to the environment and our food security. Yet, operating with an audacious outright disrespect to the country, especially the very local communities, that they are ripping their only means of livelihood.

I am shocked by the Chinese Ambassador’s presser about the Sanyang situation. Foreign direct investments are just not about profits at the expense of the host citizens. It must protect and improve the lives of both countries. The foreign direct investment must be a win-win for both countries engaged in the business. This fishmeal business is a direct assault on our existence; and that of future generations. I am seriously unnerved at the Gambian government’s mute on this issue. If the government and its officials are not complicit in these operations, these fishmeal factories have to cease operations altogether.

It is only in Africa that “foreign direct investments” deplete fish from our seas, smuggle all timber from our forests, encroach and illegally acquire fertile land, confiscate women’s gardens, deplete black sand from our coastal towns, causing a severe economic and environmental disaster for the countries/continent. These coastal town communities have been helplessly complaining about the environmental havoc, recklessness, and severe hazards. These operations are costing them their survival, but their plea falls on deaf ears. This erosion and broad daylight robbery of the country’s future cannot go on. If China wants to engage in business in the Gambia, it should engage in companies that will benefit both countries economically, foster communal relations, and respect ON equal terms.

I am calling and pleading to the government, environmentalists, activists, and all concerned citizens to make their voices known against these Chinese fishmeal operations. To come together to fight this ruthless, destructive enterprise under the guise of a “Foreign Direct Investment.” What a shame. A Gambian national will dare not catch a frog in Chinese waters much more deplete their seas of their primary source of nutrition without repercussions. What is happening in the Gambia is not a business deal or engagement but an assault on our dignity, human rights, and livelihood.

Given the numerous protest and growing sentiments of the locals in the east coast region of the country, if the Gambian government and its officials are not complicit in these operations, these fishmeal operations should have been stopped immediately. As these fishmeal operations continued to cause them extenuating damages economic and environmentally, the soundings of their alarms kept falling on deaf ears of our leaders.

Well, the heartless and unfair comments coming from the Chinese Ambassador regarding the Sanyang incident suffice what the outcome will be. Chinese direct foreign investment in the Gambia and Africa must be a win-win for businesses and the engagements of collective interests of their citizenry. They must follow the countries’ rules and regulations regarding their operations and respect the welfare of the host country’s citizens. The sad Gambian reality is that these Chinese fishmeal operations could care less over the lives of our people, and they must be shut down immediately! They are abusive and detrimental to our survival.

By Bruce Asemota on April 1, 2021

Justice Ebrima Baa Jaiteh of the High Court in Banjul has given 12 days to Principal State Counsel K.Tah of the Attorney General’s Chambers and Ministry of Justice to file charges against 22 suspects alleged to have attacked and burnt Sanyang police station.

Justice Jaiteh made this declaration yesterday, 31st March whilst presiding over the criminal trial involving the State and 22 persons.

The 22 suspects were alleged to have made their way to premises where they ransacked the facility at a factory and set ablaze the company’s offices and the personal effects of its employees.

The suspects were also alleged to have been armed with stones and sticks and set tires ablaze in the middle of the road, attacked policemen who were sent to quell the situation, as well as setting the police station ablaze.

Defence Counsel Lamin Darbo had raised a preliminary objection to the summons on notice filed by the State, noting that only seven suspects’ cautionary and voluntary statements had been obtained, whilst the remaining suspects’ statements are not before the court.

Lawyer Darbo also raised the detention period of the suspects, arguing that their continued detention without charge is a violation of their fundamental human rights.

Principal State Counsel K. Tah had intimated that it needed 21 days to prepare the bill of the indictment as the matter was still under investigation.

But Justice Jaiteh informed the court that 21 days was long considering the suspects are under custody, noting that the summons on notice cannot be heard by the court.

Justice Jaiteh stated that the court cannot at this juncture entertain any applications for bail and advised Principal State Counsel Tah and defence counsel Lamin Darbo to work closely with each other so as to assist the court at a just conclusion and the matter was adjourned to the 15th April 2021 for further mention.

By Louise Jobe & Hatab Nyang on 24 March 2021.

A trial magistrate in Brikama has on Wednesday, 24th March discharged twenty-two Sanyang youths, who were facing charges of arson and three other criminal counts following the 15th March violent protest in the coastal town.

Principal Magistrate Isatou Dabo of the Brikama Magistrate’s Court said: “She: “The practice of mentioning cases at the magistrates court and applying for transfer to the high court on a basis of lack of jurisdiction seems to be a tactic by the prosecution to legitimize the detention of the accused persons pending such time they are ready to file a fresh indictment at the High court. The court cannot be used to legitimize what is unjust procedurally especial where it is certain the procedures to be followed before an indictment is filed is one that does not happened overnight.”

On that basis, she discharged the accused persons and ordered for the case to be transferred to the Special Criminal Division of the High Court.

Magistrate Dabo made this ruling in the case of the Inspector General of Police and 22 Sanyang youths. The ruling was premise on the contention on the prosecution and on the application for the case to be transferred to the High court and the bail application for bail by the Defence.

She transferred the case to the Special Criminal Division of the high for lack of jurisdiction to try the case. Equally, she raised the question as to what basis does her court has to remand the accused persons since the prosecution deems that her court does not have jurisdiction to hear and determine the case.

She said even where she decides to grant bail the high court will not be bound by such bail conditions.

“This leaves a deadlock of processes adopted by this court under these circumstances,” she said.

The prosecution relied on section 62 of the Criminal Procedure Code (CPC) Legal Notice Number 3 of 2009 in making their application for the matter to be transferred to the high court.

Lead counsel for the Defence Lamin S. Camara said by virtue of section 5 (2) of the CPC, the court has jurisdiction to hear and determine the case adding the Legal Notice cited by the prosecution does not oust the court its power to try the case. Lawyer Camara said the said the Legal Notice relates to administrative and not judicial powers of the Chief justice. He argued that the powers conferred on the courts are given by an Act of National Assembly and not the Chief Justice. He submitted that section 2 of the said practice directive (Legal Notice) established a Special Criminal Division and its jurisdiction is only capital offences. He argued that the provisions of the Legal Notice do not take away the powers of the other courts to try capital offences.

The Magistrate held that the arson and rioters demolishing building charges are grave charges which carry a term of imprisonment for life.

“It is important to state that the magistrate court is a court of summary jurisdiction and I do not consider an offence attracting such grave punishment suitable for summary trial. Same may be prejudicial to the accused persons,” she said.

She held that the purpose of the establishment of the Special Criminal Division is in the interest of effective case management and expeditious disposal of cases involving capital offences.

“In the interest of justice I deem it fit to have the case transferred to the SCD of the high court for it will be in the best interest of justice and fair hearing for the trial will not be on a summary basis,” she said.

She said capital offences appears to be lengthy in nature and it is a constitutional requirement that accused persons be given all reasonable facilities and time to prepare for their defense.

On the bail application, she said: “I have averted my mind to the counts against the accused persons in this case as discussed under the basis for transfer of this matter to the SCD of the high court. There is need to refer to section 175 of the CPC on the procedure to be adopted in cases of offences proving unsuitable for summary trial.

She said it states: “If in the course of a trial before a subordinate court, it appears to the magistrate at any stage of the proceedings before the signing of judgement that the case is one which ought tbe tried by the high court, the magistrate shall stop the proceedings.”

She explained that where the trial is stopped, the CPC provides that the magistrate shall expunge from the record the accused persons answer to the charge and if the accused person had already been called upon to enter his or her defense, the magistrate shall expunge the minutes of the defense from the record and discharge the accused person and order the case to be transferred to the high court

She said the said provision is very clear as to the procedure to be adopted where the basis for transfer is due to the charge being considered unfit for summary trial.

“The emphasis on the procedure to be adopted is mandatory as the word shall is repeatedly used. As per the particulars of offence especially on count 2 and 4, I consider the circumstances of the case and the charges to be serious in nature.,” she ruled.

Over 40 Sanyang youths arrested amid unrest

The point: Mar 23, 2021,
By: Yusupha Jobe

The Police Anti-Crime Unit has arrested over 40 youth at Sanyang after a mob attack, burning of a police station and fishmeal factory last week following the alleged killing of a native by a Senegalese.

The arrest according to our sources, took place over the weekend as the police Anti-Crime Unit arrested people on the streets and compounds.

The incident followed the burning of fishing boats and nets belonging to Senegalese residing at Sanyang.

Alieu Bayo, a resident, in an interview with The Point, said the ongoing mass arrest of young people on the streets and compounds is a violation of human rights, stating that the arrest and intimidation of the youths on the streets have the potential of creating unrest in the village.

“How can you meet people on the streets and start arresting them without any verification. May be some of those arrested and taken by the police Anti-Crime Unit were even innocent. So it is very illegal.”

“I can inform you that since last Friday to Sunday arrest of young people is been going on in the community by the police Anti-Crime Unit and over 40 young people have been apprehended. So this has to stop to avoid any possible violence in the community. Right now some of us are not even comfortable sleeping in our homes,” he warned.

He alleged that the killing of a Gambian by a Senegalese citizen is not seen as a concern to the government of President Adama Barrow, while adding that atrocities committed by Senegalese nationals such as stealing and rape have rendered unsafe environment for the natives.

“We have been living with Senegalese for many years in the community. But since the establishment of fishmeal factory, it has caused the influx of many foreign fishermen in the village committing with various kind of crimes. So we are not going to sit and allow our community to be destroyed like that; and that will never happen,” he stressed.

The National Youth Council (NYC) on Friday visited the community with a view to finding a lasting solution to the problem. A meeting was held at the village’s center where youths were urged to maintain calm and allow the law to take its course.

Madi Jorbateh, a human right activist in a statement, accused the police of using forceful means of arresting people in the streets, while stating that arrest and prosecution will not address the core of the problem in Sanyang.

“Arrest and prosecution will not address the core of the problem in Sanyang. Since the Faraba incident two years ago, the Commission of Inquiry’s report predicted this kind of incidents erupting in coastal towns if necessary actions are not taken to address issues of land and natural resources,” he recalled.

The Point, in an effort to reach the police for comment proved futile.

By Mustapha Jallow on March 21, 2021

Batokunku, 20th March, 2021: Jerreh Jatta, the Alkalo of Batokunku on Friday told Foroyaa that a total of 250 Senegalese migrants who fled their Sanyang homes to neighbouring Batokunku village are secure and safe in their community.

They fled Sanyang after violence erupted there on 15th March 2021, when a mob burned-down a Police station and the Nessim Fishmeal Company in Sanyang after the stabbing and killing of a native, Gibril Ceesay, by an assailant, purported to be a Senegalese national.

The death of Gibril resulted to an attack on innocent Senegalese nationals staying in Sanyang, who quickly fled with their children due to fear for their lives.

Jatta said: “The migrants are safe and secure in my community. They feel very comfortable and accommodated by me through the VDC and other village elders.’’

On the second day, according to him, they received a helping hand from the National Disaster Management Agency (NDMA) who provided them with 2 bags of rice and sugar. He described these as a quick response from the agency.

He explained that the agency did not only stop there but they later provided them with 40 bags of sugar, rice, some gallons of cooking oil and bags of onion. He said 98 new large mattresses were also brought for the migrants by the agency.

Jatta said that though they initially faced some difficulties with water supply because the tap at the camp had a problem, the head of the armed forces rescued them by repairing the tap immediately, so that the migrants now have access to water.

He explained further that the toilet facilitates were inspected by Red Cross Officers, who then cleaned and sanitized them.

Regarding their health, Alkalo Jatta said some migrants later fell sick and health officers were attending each of them and provided medication for them.

“Right now we have some sick people inside but they are undergoing treatment through the help of Tujereang health centre. You know Batakunku does not have any health centre,’’ he said.

According to Jatta, the only problem they are facing now is lack of tents to deal with the problem of accommodation, saying some migrants spend the night at the veranda. He therefore called on relevant authorities to help provide the migrants with tents.

Jatta said his community is also provided with security from various security units, adding that they are all over patrolling the community both day and night to ensure the migrants and his community are safe and secure.

“So, there is no threat at Batakunku beach site too,’’ he boasted.

The Alkalo thanked the authorities for providing them with security and food for migrants. He was also pleased with his community members, especially women who left their work only to come and cook for the migrants.

Giving a brief account on how it started, he said the migrants started arriving at 7pm on that same day of the Sanyang incident, when he received a phone call from the Batakunku fishing centre that some Senegalese nationals have arrived at our fishing centre with their boats. He added that they came with their fishing boats to the landing site at Batakunku beside the lake. “I rushed to the fishing site and I met a lot of them (Senegalese),” he explained.

He said, the migrants asked whether they were welcome in Batakunku because they were not ready to return to Sanyang. He added that due to fear some decided to stay in the waters with their boats until they were later convinced to join their colleagues. I told them you are very welcome here but some were still in a state of fear and they remained in the waters,’’ he said. According to Jatta, some decided to remain in the waters until the following day, 16th March, when they were eventually convinced to disembark and join the rest at the camp.

During this reporter’s visit, it was observed that the Senegalese migrants were lodged at a school building. The building was under tight security comprising paramilitary, immigration officers, men in civilian clothes believed to be agents of the National Intelligence Agency or secret Police officers inside their tinted glass vehicles.

But Alkalo assured their presence was to provide the migrants and community members full security. A patrol vehicle of the Police was seen parked within the camp.

One could observe relatives and friends who came along from Sanyang trooping in and out of the building. Close relatives such as husbands and wives could be seen hugging each other as they reunited.

The 250 migrants were accommodated separately with the males staying in the school building, while the females, pregnant women and children at the Batakunku imam’s compound.

Attempts to speak to the them were unsuccessful as permission had to be sought from senior officials who were not accessible at the time.

A senior security officer told this reporter that talks were currently ongoing in Sanyang on Friday.

IGP must update citizens about the situation in Sanyang
By Madi Jobarteh

It’s 4 days since the IGP issued a press release on the Poliso Magazine Facebook page. In one sense it gave a reassuring message that the police will act according to law. But in another sense it raises more questions as to why the ‘vigorous patrols’ in Sanyang if the police already had said that the situation was under control.

But since then dozens of youths are being arrested yet Poliso Magazine has not provided an update! The initial report said there would be investigations. But now arrests are taking place when the public is not told if the investigations indeed took place and what was found!

The police cannot stay mute over its actions in Sanyang. It must not use the riotous incident to unjustly and illegally arrest and detain.

There are already unconfirmed witness accounts that some of the arrested youths are being tortured. There are reports that others are arrested at night. These are unacceptable actions if found to be true.

Arrests and prosecutions will not address the core of the problem in Sanyang. Since the Faraba incident 2 years ago, the Commission of Inquiry Report predicted this kind of incidents erupting in coastal towns if necessary action is not taken to address issues of land and natural resources. The Government only failed to implement that report.

For so long, the youths of the coastal towns have been raising serious concern about the destruction of their environment by the Chinese fishmeal companies. Yet The Gambia Government only ignored those concerns.

Riot, according to Martin Luther King is the language of the unheard. So let the Government listen to these youths and their communities to address their concerns than to ignore only to use force and law when hell breaks lose.

Gambians must not accept ever again the arbitrary and illegal use of force by the security institutions on our citizens.

Yes, it is utterly unacceptable for citizens to burn down a police station or engage in violence in expressing their grievances. But the solution to that is not to further ignore the original concerns and only focus on the consequences of that negligence that comes in the form of riots!

Therefore can the IGP issue an update to citizens as to what is reason for the spate of arrests in Sanyang! Police services in a democracy are expected to be transparent and accountable to the public.

The National Human Rights National Human Rights Commission, The Gambia must monitor the situation to equally update citizens and ensure that they police act within the law and not violate rights.

TANGO and The Gambia Bar Association must also be seized with this issue in the internet of justice and human rights.

Gibril Ceesay from Sanyang, who died after stabbing by an alleged thief as he tried to apprehend him, has been laid to rest on 16th March, 2021 at the Bunkilling Cemetery in Sanyang.

The purported assailant who is alleged to have stabbed and killed the deceased, one Ganna Sey, a Senegalese national is in police custody.

Order has been restored and troops are still guarding installations and patrolling the streets in Sanyang and the beach where a Fishmeal Factory has been burnt by the angry protesters. Anger and frustration still prevail and the feeling of retaliation if the government ‘does not do any justice’ by some in Sanyang is still nurtured.

At the funeral ground the Imam of Bunkilling mosque appealed and advised the youths of Sanyang to remain calm. He said the deceased is a very good youth even to his mosque, but he stressed that the youths remain calm.

The funeral and burial was graced by hundreds and hundreds of people from Sanyang and the satellite villages around Sanyang.

Following widespread online speculations that a cocaine-like substance remained unscathed in the burnt Chinese fishmeal factory in Sanyang, agents from the national drug law enforcement agency visited the premises yesterday morning.

After checking the substances in the factory, Demba S Jammeh, director of forensic investigation at the NDLEA, confirmed to waiting journalists that they have tested some substances perceived to be cocaine from the Chinese fish factory but they were found to be negative.

“We came here to verify or clarify the rumours that are spreading around town that there were drugs found at this factory. So far from the analysis that we conducted, there is no proof that the substances were drugs. That is the information we can pass to the public now,” he stressed.

Meanwhile, tension is starting to ease in the town following Monday’s chaotic scenes that resulted in the burning of the fishmeal factory and the police station after a Senegalese national stabbed a native.

Yesterday, dozens of Senegalese fishermen, who were at sea at the time of the incident, expressed fear about their safety, saying their wives told them that the mob is looking for them. One of the men said he has been working and living in Sanyang for a long time without any problem with the natives.

”The troublemakers are the newcomers working for the fish meal factory. So many innocent people have had their boats destroyed by the angry mob.

“We are now looking for food and water. The boys have burnt down all our belongings,” he lamented.

The Standard also confirmed that one Abdoulie Gaye was arrested with D36,000 suspected to have been taken from a safe in the burnt factory.

The Senegalese ambassador to The Gambia Basirou Sene has spoken on the recent Sanyang riot which claimed the life of a 32-year-old Gibril Ceesay, calling for calm and restraint in the coastal settlement of Sanyang.

A mob at the sprawling coastal town of Sanyang in West Coast Region of The Gambia attacked and burnt the police station to ashes after a man was allegedly killed by a Senegalese national on Sunday night.

Sene, however, blamed the Senegalese man Gena Sereh for trespassing, saying he should have not entered someone's house, taking things that don't belong to him, which led to all the problems.

He assured the Gambian people that the Senegalese government would take all the responsibility to all the victims and to those that have lost their properties.

A serene atmosphere was observed on Tuesday in Sanyang as things returned back to normalcy and people were going about their activities in Sanyang, a village about 43 kilometers away from the country’s capital, Banjul.

The village was on Monday the epicenter of violence scenes as a mob, mainly youths, attacked and burned down the village’s police station and a Chinese fishmeal company.

The mob attack came on the heels of a “case of robbery with violence” which resulted in the death of one Gibril Ceesayis currently under police custody.

Demonstration didn’t ensue on Tuesday as youths stayed at their homes. Only few were spotted on the streets.

A source, who pleaded for condition of anonymity, said youths who were arrested yesterday have been released.

“PIU officers are guarding here since yesterday to make sure peace prevail,” the source said.

Sand miners were going about their businesses. Shops and markets were opened and people were conducting their businesses without problem.

“Nessim Fishmeal Factory is still burning down. A caterpillar, two pickup trucks, two mini trucks, their main store for the fishmeal, offices and workers’ residents, were all burnt down,” our source said.

Sheikh El-Mostapha, a Mauritanian national and an interpreter at the Nissim Fish-meal company told Foroyaa that the company had lost over D3 million dalasi during the attack.

He said their Chinese counterpart had also lost about D1 million.

El-Mostapha said he run to save his live when two men armed with cutlass attacked him. He added he was rescued by two residents of Sanyang.

“We have lost many millions here. I cannot exactly state the exact amount we lost during the attack, but we estimate it to be more than D3 million,” he stated.

According to him, senior drug enforcement officers came to inspect the company as they received report that the company was dealing in drugs.

“We were questioned and samples were taken away. They discovered that it was not drug,” he said.

The fish-meal company is now under guarded by the army, who are armed with guns.

On Sanyang unrest!

Mar 16, 2021, 11:11 AM
Peace is not merely the absence of war, but the presence of justice, of law, of order in short, of government. And government cannot promote law, order and justice for all unless it is built upon a strong moral and legal foundation. In the end, the individual human heart is where war and peace both begin.

Peace begins in our homes, schools, workplaces and communities. News emanating from the Kombo South village of Sanyang is not only disturbing, but leaves much to be desired.

It has emerged in the news that angry mob in Sanyang have attacked and burnt down to ashes a police station. Youths are retailing after one of their colleagues was allegedly murdered by a Senegalese national on Sunday night.

The alleged killer is reported to be a staff of a local fishmeal -Nassim Fishmeal Factory, owned by a Mauritanian businessmen.

The 32-year-old victim, Gabriel Ceesay, according to eyewitness was stabbed to death on Sunday night after he attempted to capture an alleged thief – an unknown Senegalese fisherman for entering into his bedroom to steal.

The situation angered the youths of Sanyang on Monday who decided to attack both the community police station and the fishmeal factory by setting them on fire and also burning car tyres on the main highway before the intervention of the riot police, and Armed Forces.

The fact of the matter is since the start of operations of this Mauritanian Fishmeal Factor, they have been constant protest and criticism by the villagers, who accused some government officials of siding with the fishmeal factory at the detriment of the villagers.

Two wrongs cannot make a right. We are a nation governed by laws. If such violent incidents occurred, before youths taking law into their own hands, it would have been better if they follow the laws of the land.

Let’s remember that violence is not only a uncalled for especially in this modern day set up, it is immensely destructive even for the victors. So lets’ think twice before involving in violence act. A world for a wise is enough!

"When the power of love overcomes the love of power the world will know peace."
